Rejected warranty claim!

Anybody successfully overturned a rejected claim with Skoda UK?

Submitted a claim for problems with heated seated (bases not getting upto temperature), to be told 10 days after the dealer inspected the vehicle and agreed that they were not right, that the seats are not covered by the warranty. My argument is that if that was the case they shouldn't have looked at the vehicle in the 1st place.

Anybody help?

Heated seats are not covered? Sounds like utter cr@p to me.... Call Customer Service at SUK and ask for this to be escalated.

Your car is 5 years old, was it bought from a main dealer?

You are well out of the standard 3 year warranty period,if you've had since new. So unless you have the 5 year extended warranty or have just purchased this vehicle with a limited warranty best check warranty to see what's covered and what's not.

I bought the car 12 months ago from a Skoda dealer in Birmingham with 12 months warranty. My question is surely the dealer should have know that the heated seats were not covered before taking the car and then telling me that and building my hopes up that yes the seats are not heating as they should and will try the warranty department!

My argument is that now you've started you have to finish it. If I had been told from the start that they were not covered that would have been it.

You're right, the dealer should have just said 'nope, sorry' from the offset, instead of taking a look and asking if Skoda UK would offer goodwill. How dare they use their own time and energy to try an help you.

 

You understand that dealers are independent businesses, and not run by 'Skoda'?

 

Your dealer tried, but failed. Either pay up or move on. If you want 100% warranty coverage then make sure you never own a car out of warranty. :) A 5 year old car is less than 50% of the cost of a new one because its more than 50% worn out ;)

Warranty cover or not... Heated seats that don't work properly after 5 years is not "fit for purpose" under the sale of goods act.

Put some more pressure on and mention the sale of goods act to them.

I agree as the "standard" time is six years. He will need to stick with it though to get anywhere.

Nonsense. It is perfectly functional as a car, i.e. a mode of transport. A court will take into account age and mileage, price paid etc.

 

It's a 5 year old car. As cars get older parts start to fail, by wear and tear or simply deterioration over time. Something like the heated seat mat which has been sat on umpteen thousand times is a perfect example of this. Unless it is still covered by a bumper-to-bumper warranty then you won't have a leg to stand on I'm afraid.

 

'SOGA' doesn't mean your 5 year old car has to function exactly as it did when new.

 

It's a shame the heated seats aren't working to the OPs liking, but these things happen from time to time. A manufacturer can't be expected to fully warrant a car against wear and tear at this age when they clearly state 3 years / 60k miles.

 

Sorry to be blunt but I think its important to get some perspective and keep expectations realistic.

I think you will find (is how I personally saw it) was that the OP is referring to his twelve month warranty that came with the car at the beginning and that the dealer I think was trying to get help from Skoda, optimistically which is I think is silly as the 12 month warranty was their own I presume.

The point of six years under the soga is correct though but as I said above you have to be very dogged to be successful with that.

Your understanding of SOGA is different from mine. If an item is simply subject to wear and tear then its not faulty it's just worn. A heated seat mat falls under wear and tear IMHO but IANAL.

Anyway SOGA has been superseded and I'm not familiar with the new legislation, so I suppose I should shut up really.

I hope the OP gets his seats sorted to his satisfaction.

The "skoda approved used car warranty" is done by the dealer through a third party not Skoda/vag. Really its no different to other warranties you can get. You should have got a booklet full of tiny print saying I'd and isn't covered.

I wouldn't really class a seat heater as a wear and tear item.

 

The heated seats in my Skoda Felicia that was 13 years old when I got rid of it still worked perfectly!

 

The 12 month warranty provided with an approved used car are backed by a 3rd party company I believe and not Skoda UK.

 

That's the understanding I got when we had a couple of bits replaced under the warranty (starter motor, ignition switch and the handbrake trim).

Which is what I thought you'd have and is exactly what we had with our now 5 year-old SII. I had the DMF replaced under the SUK used car warranty and a couple of other bits too, just three days before it expired.(thank heavens!). 

 

As I suggested - call SUK CS and ask for this to be escalated to a Manager. They should have the information on their system regarding the claim put in by your dealer. Personally, I do not believe items like this should fail in less than 1/2 the expected life of the vehicle.

Quick update - Skoda UK have been in touch and asked what the problem was, explained, asked whether the vehicle had been inspected by a Skoda dealer ( strange as I have been told the Skoda UK rejected the claim), mileage of the car.  I have been told that I will have an update on Thursday as to the status of my claim. Fingers crossed.

If the dealer has not mentioned that its your fault ie you damaged the seat,then if its that important to you.

 

Go through the small claim court (or what ever they call it now) do it online  ,its very easy.

 

Did the dealer ask for a fee for diagnostics ?  if not your lucky.   Good luck.

I have been told that I will have an update on Thursday as to the status of my claim. Fingers crossed.

Having bought a used skoda then claiming on the approved used warranty twice as far as I know skoda UK were not involved at all at any stage. The dealer actually told me it was a separate company they were dealing with.

Surely, if the car was bought from a Skoda franchise and is/was covered by the Skoda used car warranty, then a phone call to Skoda to ask the question would clear it up one way or the other.
