Fabia CV Joint Replacement

3 months ago I had a cv boot and gaiter replaced on my Fabia mk1 by a Skoda main dealer and this week I noticed a noise when turning and took it back to the same dealer to be told that the cv joint will need to be replaced as the bearings have gone. I asked why this was not picked up when it had the cv boot replaced and was told that it would have been difficult to tell how dried out the joint would have been.

Has anyone else experienced this happening / is it possible that it could have looked/tested fine, or am I within my rights to complain as it should have been picked up before?
