Hi all, in July I was involved in a minor car accident. A young lad on a motorbike went into the back of my bumper. We was trying to avoid insurance route so I got some quotes for him which he then couldn't afford so I had to go through insurance route. Irwin mitchell handling the case on behalf of e sure managed to win the case and get my excess back and also paid the damages to my car to e sure. Verified with e sure yesterday (my renewal date) that my no claims was now all good and there was no claim against me. This morning I recieved a letter stating the defendant Has filed a defence and now it could go to court. Surely if his insurance has paid up then case closed? Any help would be much appreciated. He's got no chance in court as the Co op have got it all on cctv anyway showing he was following too close and just went into back of me.

I wouldn't worry , have you got legal cover on insurance , he's no chance of a counter claim

Yeah mate I'm covered for legal protection. I got a feeling he's clutching at straws as hes been applying to be a bus driver not sure if having a claim against him will affect this process.

Lucky he was riding a motorbike and not driving a double decker bus with 100 people on board then.

 

Perhaps he'll think long and hard about the amount of concentration he gives when on the road and pays particular attention to the safe stopping distances on his PCV test.

Send the letter to your insurance company and let them deal with it.

Do you know if an accident against him will go against his chances of getting a licence?

You need a clean license , not sure about claims

No, it wont go against him getting a licence or employment. 

I don't see the issue; it sounds like his insurance has accepted liability, which means that you have no outstanding claim against your policy. In a legally separate move, the police and/or CPS have taken a motoring offence against him to court, and you've been notified that he has entered a "not guilty" plea to that offence. You may be summonsed as a witness in that case when it gets a court date.
