I know this has been done to death about the legality of it, and the risk of MoT failure, but my questions relate to insurance and the dealer side of things.

 

DPF Removal and Insurance Companies

 

An article in this weeks Auto Express (can't find it on their website, sorry) states if it was discovered a vehicle had its DPF removed it would invalidate the insurance.  How likely is it for an insurance company to try and establish if the DPF was present or not?  Is this a check that is currently undertaken or is likely to be added by insurance companies in the future when evaluating a damaged vehicle?  If so, would this be considered a total invalidation of the insurance or just affect the percentage of the payout?

How likely is it that dealerships will check the presence of the DPF on trade-ins?  If it was subsequently discovered a vehicle bought by a dealer and then sold on did not have a DPF present, who would be liable?  Could the dealer retrospectively sue the previous owner? 

If a buyer insists they have it in writing a DPF is present, how binding would this be?  If the seller/dealer were to use phrases such as 'as far as we are aware there is a DPF present', or ' we bought the vehicle in good faith a DPF was present' would that be enough to get the seller/dealer out of paying for a replacement DPF?

 

I would like to clarify that I am not going to be using the information subsequently provided for nefarious purposes :bandit:, I am genuinely intrigued on how this is going to affect car purchases in the future.

There is a article in this months car mechanics magazine about DPF removal & insurance etc,very imformative,id imagine a dealer would run a diagnostic on the car to see if the DPF is fitted & operational before accepting the car in part exchange,i suspect the insurance will check as a friends car got wrote off at the weekend & the insurance paid for a diagnostic check & inspection to check his car was standard before agreeing on a pay out.  :S

So all these cars with dpf removed are now illegally on the road unless the insurance co. Has been informed, and if they inform there insurance it's illegal anyway as you are admitting it's been removed MOT failure then, so you are dammed both ways now,removal is out of the question now,is that what we are saying ?

Let's assume for a second that you were insured and you hadn't told the insurer about the dpf removal. As soon as you get to the MOT you'll get a fail and unless you sort it the insurance is invalid. If you have a claim and you haven't reported it to the insurer on purpose they have the right to void the policy. Do you want to risk them finding the absence of the dpf which can probably be suspected on visual inspection?
