Car Clamping in Scotland. It is back, by order of a court.

Featured Replies

Just watched on the Lunch Time News.

A man who never paid his fine for 'Having a wee in the street' had his car clamped by order of the court.

He is the first & Had to pay the fine and other costs, clamping, storage etc.

EDIT. well i mis-heard that as usual or the BBC are talking sharn as usual.

'Their report today was, "the first in Glasgow to be clamped for not paying a fixed penalty ticket."

he had been fined £60 for Antisocial behaviour'.

was already happening for the past few years i see with a google.

TV licence dodgers etc.

Still think private companies are barred from doing this for parking. This was for non payment of an unrelated fine.

yeah they are just seizing his property to "encourage" him to pay his fine. Quite right too

From what is seen on "The Sherifs are coming" ( and it's high court officers in England ,not court officers as in Scotland) , it seems that car clamping is seen as an easy way to "persuade" folks to cough up . However ,it seems that in civil law innocence has to be proved . If the car is not owned by the user ( on HP ), the user has to prove this rather than the court officers .

That's precisely what's been illegal here for the last 20 or so years. Only the authorities can clamp you, not private contractors

Private contractors employed by the authorities can?

yes if they're enforcing a court order I guess. The basic difference is you cannot be clamped for parking. But if a court has authorisied your property to be seized under proceeds of crime legislation or (apparently) because you've not been paying fines then your car can be clamped and seized.
