Trading standards - got me thinking..

After seing a few people called trading standards over that intercooler problem I'm considering given them a call myself.

I bought my car from a guy, which I've later found out owned a garage. He stated the timing belt and water pump had been changed and had stamped the service book with the garage name and info on etc...

This belt has not been changed and I would say is over due now so, IMO has done over 60k miles although its hard to say exactly how many miles it has done its clear it isn't the 500 he claimes.

Where do I stand?

I have a sale saying its been changed.

I have a service book stamped with details.

I have the advert sayings it's changed.

You would need to prove it hasn't been done. Which means a trip to the garage to have it assessed.

If the seller is in the motor trade then they have a 6 month duty of care and have to either rectify the problem or give you your money back which ever is cheapest I think.

I work in a garage so that no problem at all.

I know for a fact it wasn't done so can get as many garages as I need to check it and get it in writing, but what do I do?

Still go to trading standards etc?

Im in the exact same situation. I phoned up the garage to double check it had been done at the stated milage and he said they have no record of my vehicle having any work done there. When i asked why would it be stamped in my service book he replied "well erm.. our stamp is kinda left out to the public so.."

What do you think i should do about that?

Not hijacking your post Hutchy, just showing unfortunately im kind of in the same boat besides the fact i never got my car from the garage where the cambelt was apparently done (and lied about)

To start with you need to contact the seller and see if you can sort it out between you. if that gets you no where then contact Trading Standards.

If you bought it from an individual as a private sale, basically tough!

If he is a trader pretending to be a private seller then trading standards may get involved, ring them and see what they say.

quote the goods and services act of 1982 and the goods being "fit for purpose", state what you want them to do and INCLUDE a timeframe and send this in a recorded letter to them (keep a copy yourself) thats what trading standards will ask you to do

Everyone seems to go running off to trading standards (not saying you, but the other thread and previous posts I've read like this) before even giving the company a chance to sort the problem out. Yeah the chances are he might say do one but then he might say he'll send you the cost of the cambelt.
