Advice on a motoring charge

Featured Replies

Posted this on a bodybuilding forum I frequent but posting it here for some more in depth responses.

Long story short. Dvla are attempting to charge me with no insurance on a vehicle I owned earlier this year. The car wasn't being used but I forgot to declare it Sorn. When I got the reminder about it, (as I was giving the car to my girlfriend's son anyway) I moved the car and sent off the v5 in his name. Dvla says they sent me a fixed penalty notice but I did not receive it. I've checked the v5 from girlfriends sons v5 and its states that he acquired the car on 11/02/16. But dvla state I was the registered keeper on 18/02/16. ??. I'm off to citizens advice tomorrow but wanted some input on where I stand with this?....any responses appreciated due to my long winded post:)

If you had the car registered in your name untaxed but not Sorned then you will be fined.

If the car was registered in your girlfriend's son's name untaxed but not Sorned then he will be fined.

Thanks for your response. So does that mean it will just be a generic fine? £100 I presume? Or could it be point's and a fine?

Also....the car was taxed the whole time but off road. Doesn't make a difference I suspect?

It seems that you have committed an offence. No SORN - then it doesn't matter where the car is kept it must be insured.

Also remember that road tax cannot be transferred to the next owner. They must re-tax it before they can drive it on the public road.
