some legal-ish advice needed please

peeps maybe someone could help me out here?

i was on my way to work this morning and, sitting in a queue of traffic, a guy drives up beside me and starts yelling and gesturing.

he had his window down so i lowered mine a tad, doors were locked and was cautious in case it was a car-jack situation, and he accused me of hitting his car, with mine.

he pulled over and proceeded to ring the cops, so i stopped and got out.

it turns out he was going along a road, about a mile from where i was, and a guy came in the opposite direction and took his driver side wing mirror off, for some reason he thought i was me! it was not.

i did'nt think to ask him why he thought it was my car, heat of the moment and all, but the upshot was the police said they would not come out since no one had been hurt and they said they would "look into the matter".

some of you may recall a thread i posted a few weeks ago that stated a guy was driving around in my trade-in with the reg of my skoda, cherished transfer, the dealer having not changed the reg mark on my old car? if the guy this morning accused me because of info based on a number plate, i bet it was the person who bought my old car, make sense?

anyway my question is this: should i ring the police, or/and indeed my insurance company, to inform them it was not me, or just wait?

any advice would be great, cheers.

Check your home insurance policy.

Our Direct Line policy has a free legal advice line that you can call for such matters.

It's probably a term of your car insurance policy that you have to notify them of any incident. I'd be inclined to think that you should ring them straight off to let them know what's happened and ask them what to do, explaining of course that it was nothing to do with you. As it will land on their desk if the other driver makes a claim, it would be better to make sure you are within your insurance contract terms.

I'm sorry that this is only my opinion with no knowledge to back it up - just my view.

PS The police should have given you an incident report number.

Do you mean that your new car is the same cherished number plate as the old car??? Does that mean that there are 2 cars out there with the same number plate, cos surely that's not legal???:confused:

I'd phone a legal dept somewhere (eg the one with your car insurance) and make sure that your insurance knows not to pay the claim.

Go to the local police station and get them to inspect your car to show there is no damage which would have been caused by hitting a persons wing mirror off and log the claim with them.

Personally I'd say he has not proof you did it and there are no witnesses to say you are so he hasn't get a hope in hell of getting anywhere. Especially since you are harldly going to have hit him going the other way then turned around and caught up with his car.

when i traded in my previous car the main dealer sorted out a new reg mark for it, since i wanted a cherished transfer, but the small dealer he sold it onto did not bother his *** to put the new reg mark my previous car. dvla are aware of this and have sent me a letter confirming such, and that i am no longer registered owner/keeper of the previous car. the police alos have this info, make sense?

makes sense but what your saying is someone else sold a car withj your cherished plate on it?

If it legally registered to your actual car - you'll be fine

yes the reg mark on my skoda is legal, via dvla. i've just rung my insurance compnay and the police to report what happened this morning so wait and see.

it turns out the police have no record of this guy ringing them, so it must have been a bluff on his part to try it on with me, maybe to scam some money? the cops recorded what had happened and my insurance company did the same with a note to contact me should they get any sort of claim from an other insurance firm.

There has been a bit in the news recently about car insurance scams, but that was more gangs deliberately 'causing' accidents. Maybe this is a variation on a theme...:confused:

Sounds like you've got everything on record now. It might be worth following up with a letter to your insurer confirming the main point - i.e. that "I don't know what he was talking about and nowt to do with me". It never hurts to have a written record IMO.

Hopefully you've heard the last of it.

thanks for the positive comments peeps, the whole thing is not what you expect, or need, to happen on a cold, rainy morning on the way to work.

as others have written, i'm going to forget about it and do nothing. regards.
