Could arguably claim that he was employed and that employer agreed to a net amount and thus thought that employer was taking care of the deductions - compare to footballers who agree net of tax deals. Aside from the potential tax bill my concern would be the souring of the relationship with the employer - if employer ends up footing the bill he's unlikely to be happy! That said, we pay our gardener £15/h so your bro may be better off going it alone - there's a lot of legitimate opportunity for offsetting costs when self-employed too.
