Cant get rid of my car because of insurance why!!!

As above, get some professional advice on this. Maybe talk to someone in the know, or one of the insurance site sponsors here. And keep the use of the Ombudsman in mind as well.

My firend had built up full NCD and then had a company car for 5-6 years. When he then got a private car he went to use is full NCD and was told he was lucky he did it when he did as it was about ot expire (think it last somewhere around 7 years). Apparently driving on a company policy does not count towards it!

NCB is only valid for a period of 2 years after that anything to have is not taken into consideration.

in the case of personal injury claims the TP's solicitors have up to 3 years from the date of the injury to commence Court proceedings. Thereafter, how long is a piece of string?

Even though they are making a fraudulant claim, And her injuries cant of been that bad if they were able to get back behind the wheel a few days later to be involved in a more serious shunt.

Plus they have deliberatly battered there car to make it look worse and this has been proved in one report just awaiting the third parties solicitors inspection report which i am veryconfident that will show the same facts as report number one.

Just this min got an email from my insurance saying that they have spoken to the third parties solicitors and they are ok for me to part exchange my car and that "they are still going through their report/inspection with their client" (the one making the fraudulant claim)

They still havent sent this report to my insurance, maybe they think they are screwed and are looking for another angle to move forward.

How can they say that i caused most of the injuries from the second crash just a few days after the "minor bump" with me when its hard to prove her first set of injuries as she only attended the hospital after the bump with me 2 days later and that the drs notes from that visit state they treated the person for "suspected whiplash" and wasnt put down as a true diagnosis and wasnt even given a neck collar just sent home with pain relief.

Its after this visit that they then got intouch with the solicitor to file for 15k of personal injury. Then their solicitor instructed one of their drs to give their client a medical to determine the serverity of the so called injury of what they were claiming for but although this was arranged they never made the appointment for this medical becasue just a few days later...bang they were involved in a further more servere accident and then as such filed for personal injury with the other person that was involved in that second accident pluss still trying to persue my insurance for something!

I feel it will be very difficult to prove as so far there appears to be no real evidence of injury other than she attended hospital for a "suspected whiplash injury" but the thorough medical never got carried out due to the second accident that they were involved with.

Its a tough one, but they cant blame the more severe injuries from the second crash on me as this second accident was more servere where their car was hit by a van that went in the back of their car at around 20 mph)

Seriously though, make sure your insurance co gets a copy of the report ASAP and I would say before you PX the car. That way if it reads utter **** then you have the car to get another (3rd) indy inspector to look at it.

This goes back to july when i was involved with a minor bump since then the other person has filed for personal injury but was later involved in another RTA just a few days after.

They have also made the damage to their car worse (to substantiate their claim) and now my insurance have inspected my car that has proved that my car did not cause the damage to the third parties car to the extent they are claiming personal injury for.

Then my insurance went to the other sides solicitors with this report and asked them to withdraw their claim and that my insurance would not be paying out for anything.

Then their insurance wanted to get "their engineer" to inspect my car this happend 5 weeks ago but my insurance still have not had a copy of this report (from the other sides insurers) despite asking for it 4 times.

Now as its going on nearly 6 months since it all happend i have decided to part exchange my car but have been told that i can not get rid of the car because there may be further inspections of my car that may be needed (why) as both sides have now inspected both cars.

Why cant i change my car just because of someone doing a fraudulant claim by damaging their car more to make it look worse.

Surley this isnt right, I am goimg to miss out on a fantastic deal because of all this and why should i keep the car because of all this.

Its a real joke.

I dont think you'll miss out on any fantastic deal TBH, salesman will always make new ones.

But it doesnt help being kept in limbo. Hope you get things sorted ASAP.

From the other side of the barrell I am working in cust services and if you don't have any authority to take action or even if a manager just fobs you off then you just p*** a lot of people off.

I'm afraid that you won't be able to get out of paying all the outstanding repayments on the premium. You're not insuring the car month by month, you've taken out a finance package on the premium. If you have no outstanding claims then you can generally leave an insurance policy and they will pro rata the premium (so it seems like you make no more payments) but I've yet to see a policy with an outstanding claim where they don't want the premium paid in full. If you think about it, there's no way they're going to let you off paying the full premium, because you're claiming and it's likely to be going to cost them money. Sorry.

And deals are only getting better for customers at the moment. I reckon next summer will be the best time to buy a new car, maybe next autumn, it all depends on when the economy starts to pick up.

Yeah I know where you are coming from, and to be honest i dont want to leave my current company they have been good so far its just the solicitors who are being awkward.

I thought that dec and january where the best times to get a car as the demand is low.

I just hope all this gets sorted soon as the other party deserves nothing apart from a bit of paint on their bumper :rolleyes:

Thats a good point you never know what they say now may change in the light of day.

Simple way to speed this up, counter claim for YOUR losses, stress caused blah blah. Your insurance firm should be able to assist with this. Yes, claim their a** into 2009 - via civil courts if necessary, as it's only £50 to start rolling....

Watch it get dropped like a stone. Then carry on and nail their fraudulent a** to the wall for the suffering they've put you through.

Ref the dead lock issue, could be either a faulty lock or conveinince module. Either way, you'd have to fix before anyone would consider buying from you.
