Cant get rid of my car because of insurance why!!!

This goes back to july when i was involved with a minor bump since then the other person has filed for personal injury but was later involved in another RTA just a few days after.

They have also made the damage to their car worse (to substantiate their claim) and now my insurance have inspected my car that has proved that my car did not cause the damage to the third parties car to the extent they are claiming personal injury for.

Then my insurance went to the other sides solicitors with this report and asked them to withdraw their claim and that my insurance would not be paying out for anything.

Then their insurance wanted to get "their engineer" to inspect my car this happend 5 weeks ago but my insurance still have not had a copy of this report (from the other sides insurers) despite asking for it 4 times.

Now as its going on nearly 6 months since it all happend i have decided to part exchange my car but have been told that i can not get rid of the car because there may be further inspections of my car that may be needed (why) as both sides have now inspected both cars.

Why cant i change my car just because of someone doing a fraudulant claim by damaging their car more to make it look worse.

Surley this isnt right, I am goimg to miss out on a fantastic deal because of all this and why should i keep the car because of all this.

Its a real joke.

That's the problems these days, some people are claiming whiplash and all sorts to to gain extra money. All it does is bump the premiums for everyone else.

As you say as the cars have been inspected and as you own it, you can do whatever you like surely?

My Insurance company told me...its a p+ss take I cant get over this, even when i phone for a quote for a newer car they wont give me a price and say its because of an ongoing claim that needs to be resolved.

How long does it take! :mad: its 6 months in january and I own my car but i dont want to shoot myself in the foot by getting rid and dont want them thinking that i have got rid of my car in order to hide something even though they have reports on my car that is in my favour that my car could not of caused the damage to the other parties vehicle. Its a joke

get a solicitors letter advising them you're selling it and they cannot stop you providing you own it outright, prob cost circa £25 send it to both parties that will sort it

Seriously though it is up to them to sort it all out. I would also assume that the whole issue over whether your car 'could' have caused this damage (as opposed to wheter it 'did') will be down to it's model/shape/size, etc. Therefore why would they need YOUR car to prove this?

I think it’s a bit of a joke. Their incompetence isn’t your problem. Are they going to make the difference 6 months of depreciation lost from your car? It may not be much but its your car & your money at the end of the day. Have you tried a quote from a different company.

I have and it looks good but i pay my current insurance by instalments and this isnt up untill may 2009 so if i went with another company i will have to pay off the remaining payments for my current insurers up to may next year. Then they would not see this issue through because i have changed companies

And what if my insurance have blocked me from getting other insurance because of this ongoing claim.

I'd be trusting Gilly's advice since he knows a lot about this area of work.

You wouldn't have to pay your insurance off in full. You can cancell at any time. might be a small charge though.

I think that I and others would like to know the name of this insurance company.

I would hate to think that anyone of us is insured with a micky mouse

company that acts like this.

They all hate bad publicity more so now with the cash crunch affecting us all and the need for good service..

After we all pay a lot for the cover in the first place, and we all expect

a fair deal.. That dont appear to be in this case.

Go though the ombudsman they will be able to tell how you stand legally and wont cost you a thing as they are the regulators of insurance

At least this way if you are told that they cannot make you keep hold of your car then there is nothing that the insurance company can do

When a new insurer asks if you have made any claims, then you will have to mention the ongoing fascade. Plus your current insurer will suspend any NCB until it's resolved which has a knock on affect with the new insurer.

As you pay monthly when and if you cancel the current insurer will charge to an admin fee plus a portion of the time you have been insured with them.

Its not the insurance its the other parties solicitors who they are being represented by in regard to their personal injury claim, its the solicitors that my insurance company are waiting on to say yes its fine or no if they need it to do more inspections.

The bump was no more the 10 mph and you would think someone had been seriously injured they way this is going.

What an end to the year, the bloody central heating boiler blown up last night so have to sort that out :rolleyes:

If you did keep paying your other insurance you would also not be able to have your no claims discount on your new car. This is because the discount can only be applied to one insurance policy and that will be for your existing insurance. Hence as above it is better to cancel outright and go some where else. Another interesting point on non claims bonus I found out from a friend is that it has a shalf life. My firend had built up full NCD and then had a company car for 5-6 years. When he then got a private car he went to use is full NCD and was told he was lucky he did it when he did as it was about ot expire (think it last somewhere around 7 years). Apparently driving on a company policy does not count towards it!

Don't forget to put in a claim for depreciation on your vehicle and other losses on a sale as you couldn't change cars due to this fraud. The wonderful world of uninsured loss.

I have just been intouch with my insurance and they still have not got an email back from the other sides solicitors to say what i can do with my car and said they are being akward about the whole thing my insurance say its not them its the solicitors acting for the other sides claim.

I am only changing the car because the car now deadlocks 3 doors when inside and you cant get out from inside and nobody can open the doors from the outside. The only way to get out is by the front passenger door (sliding your **** over the gear stick :rolleyes:)

Why should i keep an unsafe car - which is why i want to part exchange it into a garage.

That puts a completely different spin on the matter.

The TP solicitors have no right to instruct you what to do with the vehicle, unless they first get a Court Order requiring you to keep it available for further inspection, and having already arranged for one engineers inspection it is extremely unlikely they would go down that route - any normal Judge would throw it out.

As regards how long does it take - in the case of personal injury claims the TP's solicitors have up to 3 years from the date of the injury to commence Court proceedings. Thereafter, how long is a piece of string?

I would still take legal / professional advice as mentioned above, but write to the TP's solicitors (recorded delivery), with copy to your Insurers, stating that you are proposing to dispose of the car and giving them,say, 28 days to complete any further necessary inspection.
