Rear seat release broken, is it a MOT failure?

The release for the rear fold down seat on the passenger side has broken :( - I see from threads on here that this happens - so the seat can't be folded down without fiddling with a screwdriver from within the boot.

It is latched securely in the upright position.

Haven't got time at the moment to faff around with it to fix it, but the car is due an MOT soon, would this be a failure?

Hmm, just thought, guess this still be covered under warranty (got about twenty days to go till the three year mark)... Anyway, will it pass the MOT?

I would say so, if it's stuck upright, based on this.

Mine's the same on the wide portion of the seat. I did a search before but can't find a thread on how to fix it. Did you come up with any results? I planned replacing the rod that seems to have snapped with a cable but can't work out how to get the seat cover off to do this without damaging it. I use a screwdriver to flip up the catch at the moment.

I don't think they'd fail it if it's locked in the upright position, it would only be a safety issue if it couldn't lock out.

Temporary solution. Put a childseat on the broken seat and the MOT tester won't go anywhere near the seat or seatbelt.

Or take the rear seats out, then there is nothing to fail.

Why should it fail if the rear seat is locked in the upright position?

What about all the saloon cars without folding rear seats?

If it wasn't secure you might have cause for concern, but I don't think I've ever seen an MOT tester check that a rear seat would fold down.

If they're secure upright, then they will not fail :)

Thanks to the MOT query answers, I'll book it in and see!

I didn't see an actual thread on fixing it other than a number saying the rod/mechanism was broken, use a screwdriver to release the seat. I expect you have to peel the grey backing off to get to it, or there's some method of prising out the top plastic catch and cover. That's why I haven't time to faff around fixing it.

Any pointers about fixing welcome, although I will try and see if I can get a Skoda service centre to sort it.

Fixing is "don't know", but I thought the MOT question was more pressing.
