If it's more than 1/3 off then almost certainly fake.

Sadly most of the time you'll only find out when your data vanishes and your 8gb suddenly becomes a 128mb corrupted mess

well ive ordered two for the moment, swmbo flattered her eyelids and said her 1gb one (which was borrowed from me) is full and she needs a bigger one. if they are legit in legit packaging and work (as well as windows recognising it as a kingston and not mickey mouse) then i probably get some more.
