I'd be tempted to mention to your insurers that you believe the guy claiming off you to be making a fraudulent claim as he seemed too well prepared with the story and the damage claims.

Looking at both lots of damage, I think its fair to say that there is no way the damage to the golf is related to your accident.

Its a shame that the golf picture isnt clearer and showing it already being dirty.

I agree.

He has pre-existing damage and either hit you on purpose or is using this as an excuse to get it fixed.

Got a letter off his solicitor.

"our clients vehicle was proceeding in the inside lane of the M60 when without warning a motor vehicle owned/driven by yourself , travelling in the outside lane, without warning, changed lanes and cut across the front of our clients vehicle"

M60? wasn't on the M60 it was on the A663

I was in the inside lane he was in the outside lane.

How could the damage be to my offside and his nearside if he was on the inside.

He's an utter ****

Use your legal cover on your policy if you have it. I was hit at the back in September and we're still arguing the you know what.

Got a letter off his solicitor.

M60? wasn't on the M60 it was on the A663

I was in the inside lane he was in the outside lane.

How could the damage be to my offside and his nearside if he was on the inside.

This is actually just what you want. It's very obvious that his explanation is a total fabrication and can't match the damage so it's easier to tell them to get ****ed.

His solicitor sounds as stupid as the clod who hit you. Time to stand up and FIGHT.

Yup. just dont respond to them yourself. Leave all that to your legal bods.

Some solicitors are becoming increasingly desperate and uncouth and resort to directly threatening and unsettling the other car driver even when they have all the other relevant addresses. Many years ago my car was driven into by another car, I believe that it was deliberate. The other persons solicitor constantly wrote to me directly threatening actions and so on. On one occasion he even warned me to pay up several thousand pounds now because he said that my insurers will not be representing me as they are walking away from the case as it is shut and closed in his clients favor and if I do not pay, the costs will escalate severely when it goes to court and that I will have to pay all costs including damages as my insurers will not pay. Naturally I was upset but contacted my brokers who had been representing us for many years and they reassured me. They advised that the threatening correspondences where out of order and were in some way unprofessional and that to just pass them on directly to the insurance company unread.

The case eventually went to court, they had flown in a barrister while I just had a scruffy solicitor who had leather patches on his coat. All a bit unequal and worrying I thought. Anyway they tried all manor of tricks including offering technical information to the court that had not been shared between briefs. We allowed it, though the judge chastised the other side and told us that we need not have that shown in court but it helped prove our case. Their case was really undefendable and after the judge told the other side that and scalded them for wasting so much of everyones time as it should have been settled out of court. He awarded costs against them and including a sum for my witness.

Just let your insurers and appointed solicitor handle the correspondences from their side and do not overly worry though that can be difficult.

Make sure you keep that original letter as well as sending copy to your insurance company.

Is the solicitor one of the no win no fee people? Wouldn't surprise me if it was.

Whatever you do, make sure you have all the photographs you can possibly get of the damage to your car and expert repairer reports.

Also check with your legal cover, but if you can counter sue for defamation of character or a similar such charge.

If you get another letter from this solicitor and your insurer have told them to deal with them, then I would report him to the Law Society for malpractice:

If someone has been injured following an accident I believe it is a legal requirement to inform the police. Perhaps you should do so now to ensure that you follow your part. It may be that they have not done so. It may be that your accident has been a set up as seen recently in the media. It is staring to look very dodgy. In any case I think it might be a good idea to talk with the police, perhaps discuss this with the solicitor first.

The first thing I did was drive to the Police station. It was only the other side of the slip road. They weren't interested when I told them no one was injured.

That stinks of fraud, make sure your insurer knows this and I'd even be tempted to go up a police station and ask their advice just so it's on record.

As for the lawyer, get your motor legal cover involved and make sure everything goes to them. First letter to you after this and report him to the law society.

If it puts your mind at rest, if you have a decent lawyer, pictures of the junction, your version of events, the pictures of the damage to your car, and the costs for repair plus repairers opinion on probably cause of damage; then I can't see how any judge could do anything but throw the other side out of court.

It gets better (or worse). A quick look on the DVLA website states the car with his VRM is a BEIGE VW Golf. Funny that , the car that ran into me was a SILVER VW Golf.

Print it out and keep a copy for your records.

Also tell your insurer and ask if they will be able to confirm the details of the car in question.

There is a very very light beige colour on the Mk4 that appears silver in some lights... so it could be correct.

Find one on Trader or elsewhere, with a plate visible, and we could test the theory? What say you? :)
