I have owned my Fabia Vrs for a number of years now and its the best car ive had. As the vat is off the new vrs I thought id go into my local dealer robert bamford in gloucester to see how much my car was worth. After the usual haggling I managed to get a reasonable price and signed up for a new race blue vrs, we wanted a basic red one initially but the waiting time is 3 months+. Less than 24 hours I was told I may lose my temporary job and decided to cancel my order as I may be needing the money more in the future. I rang bamfords to explain my problem and that I wanted to cancel the order, the sales man said it was to late the car was on its way (from a depot in Germany) after explaining my concerns again he said he would put the car back on the system and hoped another dealer would buy it before it came to them.(apparantly the car was tagged in my name, which after an email from myself was then in Bamfords name). it was then discussed that we had no legal right to have our deposit back as Bamfords were going to be stuck with a car they may find hard to shift, and the only other way was to put the £500 deposit towards another car. I spoke with the manager to complain as the part exchange for my car I was now being offered was £550 less, he then agreed to give us an extra £150, still alot less than what we agreed originally. I left it that we would wait to see if the car was brought by another dealer and maybe get some of my deposit back. After 2 weeks and no news I called Bamfords again to be then told the car was now sold to another dealer, and my new options were to accept half my deposit or put it towards another car. I asked the question that if the car was now sold Bamfords had not lost any money so why should we, I accepted that we should pay a small admin cost for there time. After a week and again no reply we chased for an answer again to be told the manager was adamant he would only give us back half our deposit. We brought our car originally from new from bamfords and had recommended them to 2 family members who then went onto buy cars from them. We feel annoyed to be treated this way, yes we should never have signed to order the car but given our previous dealings with them and the fact is was less than 24 hours that we cancelled oh and the big fact that the car was sold on, the manager has no reason to keep our money. I will never deal with them again nor recommend them to family and friends, we have always found there service costs over priced and gone to winners garage in the forest instead. I will complain to Skoda head office and see what response we get, however i will not hesitate to buy another skoda(hopefully vrs) in the future but just from another dealer.

Write them a letter explaining that you would agree to pay them an amount as an admin fee. State that you expect your full deposit back minus this fee as Bamfords have not lost anything (except admin time of which you are willing to pay for). Give them a deadline of returning this money and clearly state that you will file a claim for the money with the county court plus costs. If they do not return it by deadline just file the claim (link>>>which you can do online<<<link) for a cost of £25. You usually find that once a county court letter arrives people usually get their act together and pay up as they do not want the hassle of court or a CCJ registered against them/their business.
