Can anyone shed some light?

My daughter has an ipod touch 4, over the last couple of days it has deleted some pictures she had on it, All by itself,

Now i don't know what is causing it, and she says it's not her!!

Any idea's, does it need an update?

has it been updated to IOS5?

has it been synced lately / before they were lost?

Not been updated, but was synced about a week ago.
