Cancelling order

Featured Replies

Hi folks,

It's with a heavy heart that i have to cancel my order for my new Superb. My question is this, does anybody know if you can get your deposit back if you cancel? i ordered the car just two weeks ago.

Cheers,

Ivor.

Surely there should be a 14 day cooling off period written in the contract, depending if you ordered exactly 2 weeks ago you might want to get on the phone soon !!

I would doubt it. Thats the nature of a deposit. Security for the dealer/manufacturer against such an occurrence.

Deposits, and not just for cars, are non refundable

If you paid the deposit over the phone by credit card, distance selling regulations apply and you have a cooling off period. If you paid face to face, unlikely I would have thought.

Yes, sorry should have mentioned the distance selling regs

It is worth trying... Dealer might return money if they are able to sell car on schedule. But it depends on dealer. Mine friend gave up on Volvo c30 as facelift appeared while he was waiting. He canceled and bought BMW. After year, they sold car he ordered and gave him half of deposit.

Well a big thank you to White Dove Skoda and Andy Shoreland. It took them a few weeks but they have refunded my deposit in full.

Distance selling regs don't matter if you've already been in physical contact.

So you can't for example, go in to the dealer, arrange the car, then go outside and phone the dealer to pay the deposit.

I'm afraid I have to disagree, based on personal experience. Back in 2007 I visited a Skoda dealer, took a car for a test drive, discussed prices with the dealer and left. That afternoon I rang him and agreed to buy, using my credit card to place a deposit. The following day I realised I had rushed into the deal and had reservations about the car. I discussed the matter first with my solicitor who was confident that DSR would cover me. I wrote to the dealer explaining the situation and after getting no response, went through the small claims court to recover my deposit and costs.

Good result for you, but where was the justice for the dealer?

The dealer hadn't spent anytime dealing with the sale, as I paid the deposit on a Saturday afternoon and contacted them on the Monday. If they were feeling an injustice had been done, they had ample opportunity to dispute my claim which they didn't. They did not respond to any of my correspondence on the matter, so I guess they were not that bothered?
