Followed two 4x4s this morning, both with both rear brake lights out apart from the high vis one...

Of course that is the standard rule - but if they emergency stop? Don't know - just seemed like an interesting conundrum!

If you hit the vehicle in front it is your fault regardless.

If they have no brake lights then the obvious thing to do is give yourself more space so you have more time to react.

I think you'd have a reasonable chance of getting some of the blame on the driver with the brake lights out. Pobably wouldn't get it to fully their fault and likely would have to fight the insurance company about it.

I've heard before now that one brake light being out is enough to make it the fault of the shunted, and not the shunter. I'm not 100% on it, but it's what I've been told by numerous friends over the years

Trouble is getting the insurance company or the police to prove the bulbs were out in the first place
