Hi all...brought my octy vrs a few weeks back, when I picked it up the aircon was not working so the non franchise trader made me pay the garage they use next door to refill it which I reluctantly did and all was well.....for two days...ac stops working as in nothing happens when you press the button so I call the trader who says drop it to me and I will get the garage to check for leaks...I did this they had it all day and said nope no leaks we have re-gassed it for you and again all was well for 2 days until yep you guessed it no AC again...now the guy, who is a nice chap to be fair, is saying its not covered under the 3 month warranty I got...I am under the impression under the sale of goods act I have a right to ask him to repair it right? Any advice on options and what my actual rights are rather than me guessing and then looking like a ****?

Yes you do have full rights to ask for it to be repaired, it's part of the car so is covered under the sales of good act. Have a quick word with the local trading standards they will set you in the right direction. The chances are the air con pump is gone.

When you bought the car did the dealer give you the impression that it was just low on gas and needed re-filling? Sounds like it from what you have said. 

 

If so then the vehicle isnt fit for purpose as it was sold faulty without the seller letting you know. They are now bound by the sales of good and services act to do one of the following: 1. Fix it 2. refund for the item (car) 3. Replacement (replace the car for an identical one) - Obvioulsy 3 isnt going to happen but they must do 1 or 2. 

 

I went though this as when I bought my vrs the airbag light was on and only bought it under the understanding the dealer would fix it. I turned up to pick up the car and it was off......for 4hrs. The dealer ended up paying £300 to skoda for a new airbag

That situation is exactly the same as mine!

When I test drove the car I checked the AC and it wasnt working.

I agreed to buy the car if they sorted the AC,

A week later I had a call saying all fixed and the car was ready to collect,

I asked if the AC was all working the sales manager said "yes all sorted just needed gas"

I sorted the paper work out and went to drive off!

Before driving off I tested the AC & supprise supprise it was warm,

I went back in and the sales guy booked it in for looking at,

The car went in a week later and I was told the AC compressor was knackerd!

This was coverd by my 12 month warranty,

Because it was a large claim (almost £1k) the warranty company wanted to talk to me to ask if it was working when I bought the car!

it was replaced with no issues :-)

Sounds to me they know its the compresser and dont want to fork out almost £1k to fix it!

My air bag light also came on before driving away (spooky)

I told them the same thing" your selling a car thats not fit for sale"

This was also fixed at the same time :-)

I love my VRS like no other car I've owned but I would never buy another with out a full warranty as I've also had 2 shockers & the MK60 teves fault & the alarm siren ,

Almost £2k in claims on a £6k car:-(

You should not have had to pay a penny out. Since you have already given him a resonable chance to fix, you could return the car and ask for your money back plus the money you paided for the "gas". I say that meaning they prolly just parked it round the back for the day. How did you pay for the car?

I paid on my debit card for the car...when picked it up he said it is just low gas which is why I paid to have it regassed...I will call him in the morning and ask for either repair or full refund for the car and see what he says then :) it sucks buying a car and something breaks on it right away! The ac issue aside the car is awesome ;)

ok, so I have spoken to citizens advice and they said I am well within my rights to ask for a repair or refund in full...so I have sent an email to the dealer (kept it very polite) and said I am looking for either a full repair, a partial refund so I can get the car repaired or a full refund and I return the car.

 

the only issue is on their website they dont list an email address it is one of those fill out your details and what your enquiry is and we will get back to you things...so I have sent it and kept a copy of the text but should I also call to confirm they have recieved said mail?

im pretty sure those come through as an email anyway.

Have to agree...... read reciept is another option on email but you can cancel the message box....

ok, I think I will call them tomorrow to see if the email has been received and to discuss options...if they deny seeing any email then I will snail mail it over and get it signed for to be sure...I presume they can just say no we refuse to do anything in response to my letter what are my options then? would I have to go through court etc?

If they so no and go away then its the route of trading standards......takes a little time to deal with and so forth but in the end you will get what you want and then some.... All trading people have to follow the rules and the ones that don't are normally hit where it hurts.....again they don't want that as its bad publicity...either way you always need to weigh up your options. 

 

If they do tell you to bog off then i would seek independent advice or go the AA route of getting your car looked. Also, if you know a really good mechanic then get them to do an independent report on your vehicle.....again, this all depends if the dealer ignores you....

It would be much better to phone them and quote SOGA. If they don't play ball then get the car repaired at a dealer and then sue them at SCC for the cost of repair.

so update....I had a call from said garage to today and they acknowledged my email and said they are very sorry I am unhappy please book the car in for us to repair it... so it looks like, following the good advice I got on here that the issue will be resolved FOC and all is well :)

 

I will let you know how it all is when I get the car back... :happy:

Make sure you get your money back for the regas.

Everything you need to do extra keep the receipt. Sometimes the places where you get the extra things done will be happy to write a report for a small fee.

update (kind of) the car has been in the garage for 2 days now (no courtesy car provided) they still cant find the leak from the AC...which by the way must be a pretty large leak to have emptied in 24 hrs! so after 2 days I get a call at 1645 today to say we have not found a leak but can confirm there is one so have used a "very specialist" bit of kit to seal the ac system...sounds to me like the 34.99 can of ****e from halfords!!! he said you can come and get the car and see how it is...which I have refused even though things are tough without my car!! I told him to keep the car until the problem is resolved so tomorrow when I get a call to say yep its not leaked what do I do? we all know that a tin of ****e will not fix an AC system that emptied fully in 24hrs....this must be a condensor fault...do I refuse and start to up the pressure? do I demand a car or partial refund due to being so put out by this??

You have given them reasonable chance to fix which they can't/won't. Def put a request in writing for a refund under SOGA. You can also claim for cost of hire car if needed.
