Problem with Golf and warranty

Just wanted to get some feedback from you guys on behalf of my parents.

Situation:

They bought a VW Golf TDI 90 auto on 2 June last year, it's a late X-plate, registered February 2001. It had less than 12000 miles on when they bought it and it has now covered just over 20000 miles.

In April it had its annual service before a holiday to the Alps. On the return journey, it was suffering lack of power. Due to the May Bank Holiday, the earliest it could go to a VW workshop was 31 May, one day before the warranty expired.

The computer had logged a fault which had closed the turbo down. This flag was cleared but the fault continued.

The car has been at the dealer now for a variety of investigative work to be carried out. The result of this is that the whole turbo needs to be replaced (which seems amazing at 20000 miles in itself). No idea of cost has been indicated but I guess it has to be into 4 figures.

VW Used Car Warranties are currently declining to pay the claim on the grounds that the warranty has expired.

Additionally, there has been no offer to extend the warranty as apparently VW have been banned from offering renewals but the insurance industry regulator. Had an extension been offered, my Dad would certainly have paid for it as he always does that kind of thing.

Surely if the fault has been brought to the dealer's attention while the warranty was in force, then it should be covered by the warranty. It's not my Dad's fault that they weren't able to/didn't rectify it at the first go.

Additionally he has taken some legal advice through his insurers and they have said the claim should be honoured.

Any thoughts on what the next step should be? I've suggested going ahead with the legal advice from the insurers, together with CAB advice and the threat of action through the small claims court.

Yes , if the fault occurred while the warranty was valid and the garage have been made aware of this then they can't simply hold off repairing it until the warranty runs out then refuse to pay.

The words "Trading Standards" spring to mind.

Give them a call as they can offer advice and, around here, are more likely to be easily contactable than the CAB.

agrre with DrZ, if the initial report was connected to the fault then they have to repair it under the warrenty.

BTW if they are looking for a new warranty quite a few people have recommended warrantys direct to me. http://www.warrantydirect.co.uk/

I've also been advised to get an online quote and then do nothing, they then usually phone with an offer of a 10% discount

Thanks Eddy, I'll pass that on. I think now it's out of warranty they'll probably just stick to the back-street VW specialist they've been using for 20+ years now. Might even take the Fabia there once that is out of warranty. :)

It's true Audi and Volkswagen at this time CAN NOT sell used warrantys - however they do have (as far as Audi are concerned anyway) an alternative from there warranty providers Mondial.

Audi have been recording the details of any customer wishing to extend there warranty and has been honouring any claim in the meantime.

I'm glad to see VW did the same,however I'm suprised they had any problem - its always been the case that if a fault started during the warranty and the vehicle has been looked at by the garage - its covered - as long as the garage can give copies of jobcards with timeclock stamps to show the date - along with customer signature.

But most importantly its been sorted!

My Dad was told that the Financial Services Authority had banned VAG group from offering renewals to existing policies; the FSA told him they hadn't applied to be able to do so.

Don't quite get it myself from a company like VW...
