I've had some roof tiles land on my Fabia roof and bonnet they have dented the roof right down to the metal on the roof,the bonnet has a dent that goes to scratch the left hand head light.

Car insurance mate usually if it's on your own property but it really depends on your own particular insurance provider.

Because you've got dedicated car insurance cover, your home insurance will probably tell you to claim on that for accidental damage.

yeah, I had the rear spoiler smashed, and it got through to the tailgate too! (by one of my roof slates) £1000 worth of damage! :o all fixed by my car insurance with £150 excess :)

You car insurance will cover the repairs, it'll go down as Effect of Storm/Weather.

You'll have to pay your excess and it will go down as a fault claim but shouldn't affect your premium much come renewal as it's accidental damage and not driver error.

As I understand it, please do correct me if I am wrong. The owner of the roof, whoever it is, is only liable if they were negligent, by which I mean did not mantain the roof properly or were aware of an issue.

If it were an accident or "act of god" then you would probably find that they are no liable unless negligent.

 

 

Obviously if the neighbours were good friends or whatever then they may come to an agreement out of good will.

 

With the OP's case I would be suprised if Home Insurance would cover it, it seems that in most cases they claim "act of god" and tell you to speak to your car insurer. It seems common practice for Home Insurance Policies to cover car damage but I may be wrong.

If you can prove they are negligent and it wasn't an act of god, i.e. the roof was in a state of disrepair.

Other insurers might handle it differently, but in most cases this is how it would be dealt with.

There is some truth in austenw90's answer as you would have to prove it came from next door, if it couldn't be proven then you would have to cover the costs yourself then try and recover the losses from your next door neighbour.

Insurance is all about risk and blame, no insurance company like to pay out so it can seem like no one will take responsibility.

I didn't even try my house insurance, I think its a £500 excess..... my car insurance is just £150 excess lol... and they were very good about it.....

 

oh , and on a side note : declare your mods! lol.... my repairer said "nice ARB, fit that yourself did you? " ... "yes" I replied, "cost me a 15% premium on my insurance!" lol.....

little different incident but might answer the question a few posts back, my neighbours flat garage roof came off and smashed my sat dish. their house insurance mentioned the 'act of god' to which i said prove it, stalemate ensued but as we get on well enough their paying for it themselves but i do think insurers need a better get out clause as act of god doesnt do it for me

seriously though i wouldn't accept that as an answer,. they could use it for almost anything if they wanted so they need a better excuse to appease me, it was those nasty little leprechauns sir!!! or perhaps the tooth fairy? either way its all a load of bull unless your about 5 years old
