The current owner is aware of cat d history. Says has been repaired to a high standard. I said he may wish to mention that in the eBay advert !

Yeah he really should!

I didnt think it had to be mentioned. It was more a case of 100% honesty as sellers descresion.

Its a bit naughty if he doesnt though. I'd be proper pee'd off.

I think you'd have valid grounds for getting your money back/legal action though as it's a pretty key detail to neglect to mention...

The owner is not obliged to say anything about a cat D unless it would effect the vehicles value. To not mention a write off would be fraud under common law,would it not?

Cat d doesnt need mentioning.

Only has to be declared if he is asked.

Cat c must be declared in advert.

Thats what I am lead to believe from various traders

Surely anyone would hpi it and check the log book before handing over money?

I asked my mate who's a trader and he said private sale does not have to be declared.  

 

This is what he text me earlier.

 

"There is no legal recourse with private transactions. When selling privately the only legal f**k up you can make is a miss description.  If you categorically state that it's not on the ht list an then they find out it is then they can maybe go to small claims, but only if you've said that.  The only complication they might encounter is if the punter phi's the car.  If not then plain sailing coz cat d won't be written on the logbook".
