In summary you are at theoretical risk of prosecution--the car dealer in this case was fined £500 with £3000 costs. I assume you would only be in trouble with the law if there were other matters bring this to light i.e the vehicle was found to be used in crime etc or involved in a serious RTA

A worrying aspect, as pointed out in the judgment is that the vendor failed to point out to the purchaser the negative aspects of this type of deal and the risks they are taking. That at least should be the minimum.

I'm of the opinion that we should try and keep to the letter and spirit of the law. They are not there just as a sanction but also to protect the unwary and vulnerable from the unscrupulous. We are not all switched on to things around us and there is potential for disaster in seemingly innocuous situations.

Suppose you didn't inform your insurance company for instance- do you think in the case of an accident and all this came out, they would pay out?

Many would be very tempted to tell a few porkies to try and retrieve the situation and end up digging a bigger legal hole for themselves. Try out Fraud and perverting the course of justice for size!

It won't happen very often, but sods law..........
