Policy wording regarding bike being kept in garage

I'm normally pretty good at reading and understanding the T&Cs but I cant get my head round this one, it's for my bike policy, seems to have 2 paragraphs contradicting each other;

 

4 – Garaged Vehicle Clause
You have agreed that You will keep Your Motorcycle in a locked garage or building either at your home
address or an address declared and specifically agreed by Us when your motorcycle is not being used.
We will not pay any theft claim under Section 1, ‘Loss or Damage’ If a theft or attempted theft of your
motorcycle happens within the proximity of your home address or the garaging address when your
motorcycle is not in a locked garage or building.

5 - Garaged Vehicle Clause, increased Excess
You have agreed that you will keep your motorcycle in a locked garage or building either at your home
address or an address declared and specifically agreed by us when your motorcycle is not being used. If
a theft or attempted theft of your motorcycle happens within the proximity of your home address or the
garaging address when your motorcycle is not in a locked garage or building, we will double the theft
excess. There will also be a claims handling charge of £100.00 (subject to insurance premium tax, where
applicable)imposed to cover the additional administrative costs

 

One says they'll not pay out at all and the second says they'll double my excess? I suspect I'll have to ring them but thought I'd check see if I'm just being stupid first

A straightforward case of heads they win, tails you lose. and no, I don't understand it either. Is it MCE by any chance?

That would be an either or case depending on what your policy states. Depending on your policy it will either be total loss or and increased excess clause. Both are in so that everyone's terms and conditions are the same but only one will apply to you depending on your type of policy and should have been informed of when you took the policy out. Call them and asknif your unsure. Sometimes total refusal will be for ttft and increased excess will be fully comp.

I'll ring them, nothing I can see in the policy cert or anything. 

 

It's not a huge issue, I understand why they are funny about it, people saying it's garaged then leaving it on the drive or something. Mine is always garaged but I hate getting it in and out the garage with all my bike kit on, feels cumbersome and I get hot :D I doubt it would ever happen but sods law the 10 min I go in to get changed some pikey will chuck it in their van and leg it lol. 

 

I'll give them a bell tuesday and see what the deal is. 

It would seem to me that clause 5 is to back up clause 4. There may be situations where it could be argued clause 4 is unfair. Therefore clause 5 would come into play.

 

Smells of a belt and braces approach where people push for clause 4 to be ignored due to circumstances.

 

Of course, if you do not own a garage or it becomes obvious the vehicle is stored outside permanently, then clause 4 would seem fair.
