Yes they did...and changed the Beige Leather to Beige Leather / Alcantara.

So with such a big change to spec I assume it didn’t cost you anything to walk away from the deal?

 

Beige Alcantara must be a bitch to keep clean though!

Well, I have to pay the £500.00 `detag` fee.

Plus any loss the dealer makes in selling it on.

So I wont know until the car is actually sold.

How can they charge you for the loss on the car when the dealer sells it.? Is that in the terms and conditions ?

Is there a base line price you have both agreed on it can't be sold at? If not, what's stopping them selling it £5k under book and then charging you?

Yes it is in the Ts & Cs.

As soon as I signed the order form (back in early October) there was no going back and the car was going to be built. I remain financially liable for any losses the dealer makes in selling it on...even if that means it has to go to auction (its all there in the small print.) I knew all this but, of course, didn't expect to have to cancel my order. 

There is no `agreed base price` but the dealers integrity will surely not allow the car to be sold too low.

Mike, I was still under the impression that you're only liable for your deposit.

So, to be clear, let's say you ordered the car and paid a deposit of £1000 (for argument's sake).

You have now decided not to keep the car, and it has been built already.

So after reading the terms you posted a while back, I thought it seemed pretty clear that in order for you to get all of your £1000 deposit back, Wings Skoda needs to be able to find a new buyer for the car without taking a hit.

If Wings Skoda needs to discount the car or incurs other charges, such as auctioning it off etc., then some of your £1000 deposit will be used to reclaim those 'charges' (or losses) that Wings Skoda is suffering because you backed out.

Lets say it costed them £400 to sell the car on... They would (if I remember the Terms) send you the receipts to prove where it costed them £400 and return to you the remaining £600.

Let's say it costed them £1500 to sell the car. They would in the same vein, send you proof in receipts and invoices, and then that's it. You lose all of your £1000 deposit.

I truly believe that your liability is limited insofar as you would only lose the full amount of any deposit paid on order... And nothing more.

Yeah, up to and including your para 6 you are correct.

But, using your example, if it cost them £1500 to sell the car, and I had only paid a £1000 deposit, then I would have to pay them an additional £500...plus the £500 `detag` fee.

Complicated int it!

But their loss... Is that relative to the price you'd negotiated with them, or the price they paid, or what? Seems that they might be asking you not to cover a loss, but to cover the shortfall of expected profit. Quite a difference!

I really dont know.

I'd always assumed that if they sell it for less than they paid for it, then that is the loss I will be responsible for.

When ordered mine (different country, but still) i was told i am liable to lose my deposit if i cancel. I've not heard of paying them extra.

That's a real shame, let's hope that the dealer is straight with you and sells it for a fair price so that you don't get burnt too much.

Wings is only 18 miles from me.....wouldnt surprise me if they initially tried it on and try flogging it for 2-3-4 grand over the asking price.....if they do, you should get a cut of that!!

It was for changing financial reasons...and yes it was tough.
