Advice on misinformation of front seats memory function

Back in November when we purchased the car, the specification brochure stated that Edition came with Electrically operated front seats with memory function now i have learned this is not the case and revised specification brochure now states: Electrically operated driver’s seat with memory function.

 

I honestly did think we were getting both seats with memory function - why would you do this on one seat and not both other than trying to save manufacturing costs, but this is top spec Edition! I expect this from other lower brands but not Skoda.

 

i have emailed my dealer and was advised:  "This would be something that you need to ask Skoda customer service, they may have made a printing error on the original brochure but this will be a Skoda error and not ourselves, we are a franchise and do not deal with the specifications sent direct from Skoda."

 

Is this correct, dealer can just wash their hands off this? After all they are representing officially Skoda UK and act on their behalf.

 

We are collecting car next Saturday, all i want is a some sort of compensation i.e. free accessory.

 

Any advice/experience how to proceed further?

Sadly I don't think you will get much as I am sure that they state that they may change what was in the broucher. If the configurater stated that and you had it in writing with reference your requirements then you are in a much stronger position.

 

You only need to read the small print on the back of any Skoda brochure, I think they’ve got it covered...

 

“Whilst every effort is made to ensure its accuracy, the information in this brochure is not binding and is subject to alteration. Some images within this brochure depict left hand drive models, with both standard and optional equipment shown. Please confirm exact specifcations, prices and colour availability with your ŠKODA Retailer who will be notifed of any changes as they occur.”

There are two documents PDF's, each has different level of importance, Brochure is just fancy marketing document with the above mentioned small print and then there is Pricing Spec PDF that doesn't not contain such small print.

What sort of accessory would you be satisfied with out of curiosity?

A company cannot hide behind a disclaimer under all circumstances.  Would you be happy, for example, if they changed your 1.5 litre engine for a lower powered 1 litre , with no change in price, and referred you to the disclaimer?

 

To establish where you stand in law, contact the Citizens Advice consumer helpline, tel: 03454 04 05 06.  I doubt if the dealer can wash their hands of the matter either, even if they are the apparent innocent party here, they are the ones who sold you the car and with whom you made the contract (dependent upon finance agreement ,if any).  Again the helpline should be able to advise.

I would say your observation should be taken up with the Dealer, he with whom you made the contract to buy, afterall he should know exactly what he is selling !!

Yes, it's funny how car manufacturers think they can operate differently to other manufacturers and hide behind the small print as much as they do.

 

Given the number of errors over the years with Skoda's brochures and other information it's obvious that they don't make every effort!

 

It's all well and good saying that you should confirm all specifications in writing beforehand but how do you know what is right or wrong in the first case and how far do you go with something as complicated as a car?

 

The OP's expectation based on what was said about the seats i.e. plural is reasonable and why would you question it?

It may not be the 'fault' of the dealer for the discrepancy between what you received and what the marketing material said but the 'not our problem' response is pretty poor customer care and at very least they should have done the leg work in contacting SUK on your behalf and getting a suitable response.

 

I bet the same dealer didn't say "Sorry Sir, you'll need to make the £30k payment to Skoda UK, we're but a humble franchise"
