Question regarding non fault claim

Recommended Posts

Hey guys I was looking at my insurance policy documents, and I saw on my policy I had a claim on there and I'm a bit confused as to this.

In Jan last year my car was hit by an older lady whilst she was trying to park her car next to mine (I wasn't even driving I had been parked up a bit luckily I was in the car as she didn't even know she had hit me) So I got her details and stuff, she originally wanted not to go through the insurance and wanted to pay for the damages, after doing the quotes I ended up claiming through her insurance as she didn't want to pay the money was something like £800 worth of damage.

After I got back from where I was I called my insurance company to notify them, encase she didn't want to pay or refused to, my insurance company had put this claim on my policy (there was a £0 pay out also listed) so I'm a little concerned/confused by this as when it comes to renewal for me next month will I have to list both claims on my quotes as non fault or just mention 1 of the claims?

I emailed the insurance company I'm with and they are unwilling to remove the claim from my policy so I'm a bit unsure what to do next as I was doing quotes and my insurance has gone up (compared to doing quotes with out declaring my 1 claim) .

Thanks, Leprejohn

@Leprejohn - It's a "no claims" discount, not a "no fault" discount. Your insurers should reinstate your NCD when/if they recover their costs from the LOL's insurance.

Depending on your excess, it may be worth raising a "small claims" action against her to recover that amount, and copying the court judgement to your insurers.

It does say that I haven't lost my NCD as its a non fault claim, I'm just baffled as to why they have added it to my policy documents, when I called to let them know and I had stated this is not me claiming just informing, the claim of her insurance was settled pretty much a few days after the accident so I had my car fixed etc.

But the increase has annoyed me slightly as I didn't think it was suppose to go up

It was a claim on your policy, regardless of fault.  Yes it seems crappy and unfair but unfortunately that's how insurers work.

When you renew your policy, either with your existing insurer or with a new company, when they ask how many claims you've made in the last 3/5 years, you have to include ALL claims, whether at fault or not, you will probably find your premium will also increase a little due to this.

Whilst you should technically inform your insurer of all collisions (no matter how small), they will still count against you regardless of fault and this is why many people are willing to get any repair work done without involving insurers.

Yeah I agree, for the amount of damaged caused by insurance has actually went up from 1.2k to around 1.7k with me declaring the non fault came with my NCD etc
