Can any of you please confirm whether the fuel flap is locked when the car is locked, you can open mine now when the vehicle is locked I'm pretty sure that in the past that wasn't the case 

It should be locked when the car is. Check and lubricate the locking mechanism, does it spring out if you press it in, does it move or rotate when you lock/unlock the car ?

Thank you for that,took it back to the dealer who replaced the actuator and it is now locking
