hey all, quick insurance question..

mate of mine thought it a great idea to put his car into another car on private land in june, theres been a few letters back and forth, but nothing further than that... can the claimant still claim on his insurance or is there some sort of time limit? does the fact it was on private land make a difference? this guy is trying to pull a fast one, saying that a tap from a vrs into the front of his car has caused a rusty bonnet to completely collapse and have a replacement..

As far as i understand it... your friend is still obliged to repair to sort it out.

He can pay for it out of his pocket and avoid insurance... but if he cannot afford to pay, he can deal throuh insurance and they will sort all the nitty-gritty out about it.

But he has to do either... but not sure of any time limits...

thought as much... just glad its him not me... although he has threatened to nick the bumper of my vrs to cover up the scar on his !

lol i keep winding him up becuse his is on an 06 plate and mines 07 (yep a vrs on an 07 :) thats not a limited ed!)

this guy is claiming about 700 in total but i reacon from the photos ive seen theres only about £50 damage if that... do u think its best it goes though the insurance companies or for matey to risk loosing his NCB?

Doesn't make any difference at all if he was on private land. not 100% sure is there is a technical time limit but it would certainly be more than a few months. I used to work for NFU Mutual (sales not claims) but certainly never heard anything about time bars.

I think the big question lies with how private the land is.......

I think he means, was your friend hooning around land he shouldn't have been on?

If you think the guy is pulling a fast one, put it through insurance and let them have the hassle

The time limit is six years for property damage and three years for personal injury.

It won't make a difference if it was on private land and not governed by the Road Traffic Act 1988 (dependent upon whether it complies with the definition of a road) as common law will still apply, i.e. a duty of care, a breach of that duty and resultant damage.

Although insurance will only return the car to it's previous state so if the bonnet is rusted as you say it would be good to get some pictures of it
