If the worse happens, and you end up having to sort it... you could save a few pennies by getting hold of a red wing from a breakers.. Red's one of the more common colours so shouldn't be to difficult. Then it just bolts on, you could probably even do it yourself if ya handy with a spanner.

Sucks though mate, REALLY hope it goes your way and the other guy doesn't get away with it.. My friend had a completely fictitious claim against her a few weeks ago.. She contested it and apparently the other party just vanished.

Like you say, that damage couldn't have happened with the description of the accident and hopefully the insurance people will have seen it a million times before and know it was his fault, rather than yours...

Another Fabia driving friend got his back door reversed into as he was parking.. The other driver got out and said "No matter mate, just a nik".. to his car but not the fabia.. to which my mate says "Umm.. YOU backed into me" and the offending car says "Well, Yeah, I was in reverse but my hand brake was on????" Unfortunately my friend couldn't see the point in claiming so we'll see if it polishes out... He'll still have a nice lil crease though but it's bellow the rub strips luckily.

No one ever admits it's their fault, do they... Makes the whole thing a joke... I got rear ended and the lady admitted it on the spot, and even to her insurance who wrote me telling my it was her fault... THEN they claimed the bill was too large and it took 12months for them to pay up... so even when liability is correctly placed it can still take the p!ss...

I know what you mean mate i just couldnt understand how he thinks he was in the right even when other people were telling him other wise. In regards to the replacement panel the only issue there could be is that the panels might not match up in colour but i i will look in to it. I know some one who runs a body shop so will get a quote with him as i have kinda come to the conclusion from what the insurance company told me that they are looking at a 50/50 ( because they are lazy and cant be bothered to do some work ) which means its prob not worth me using them

And it's getting more common... it's not going to get better either with the claim culture we now have.

They will often settle something like this 50/50 because there is no way for them to know who is right when it's one driver's word against another.

Even with a witness they can still go 50/50 because with no actual proof of what happened it could quickly cost them more to fight it in legal costs.

Once you factor in the legal costs and credit hire of a car even a simple bump with a whiplash claim can hit 10k now, which is why most people's renewals are going up and up in price, even though the claimer doesn't get that much. The costs involved have gone through the roof and this is driving the premiums up.

If you are cynical like me it makes a lot of sense.

The population is growing... the road network isn't.

How do you control the number of cars on the road?

One way is to make is so expensive that less people can afford to drive.

Indeed, especially with the insurance companies farming out work to subsidiaries so they can inflate the cost of claims off each other, together with selling details on to personal injury firms ... :( There was a funny moment on "Money Box" (BBC Radio 4) on 17th Sept (first 7 minutes) where RSA tried to sue someone after an accident, and they'd produced an increased bill by using their subsidiary - the judge told them in no uncertain terms to stop it. :)

I said what about my bumper, she said well you can sort that, she even admitted she didnt see me and I was almost fully out of the space lol, ended up goin through insurance but neither of us is admitting liability so no idea what happens now, my place told me I wouldnt lose my no claims if she ended up being at fault, this true ?

Im dreading insurance in the summer, may force me into having to sell the vRS :( i got 0 no claims, 1 claim against me and my car is modified :|

Reading what you have said I'd say it's no claims bonus goodbye.

No mention of witnesses and you were reversing out of the space and hit a car. They will say you're supposed to wait until it's clear before reversing in a car park. Doesn't matter how much out of the space you were, you were partly at fault.

Not sure what "my place" is, but if that's the insurance company they are only going on what you said. Once they see the claim from the other party and she is not admiting liability and instead saying you reversed into her it's probably another 50/50.

There is no way for them to know if you reversed into her or she drove into you. Or both at the same time.
