tdi clutch/gearbox noise in 5th and legal advice needed please

So, background, have had an '05 Octavia 2.0tdi for 4 years now, has been a sound on the clutch since I got it, when setting off in first, a kind of scraping whine noise, got it looked at early on, slight glassing on clutch plate, no real problem, never worried about it, no slipping, fine.

Got new hybrid turbo and 180bhp remap from Sharks a year and a half ago, still fine, works great.

Decided to get the clutch+flywheel swapped, had the money, went for an OEM as I have no plans to remap anytime soon and an OEM can take the torque from the map

Took it to local garage I use a lot.

When I got it back, I noticed straight away that there was a problem with 5th gear, when changing into 5th as I release the clutch pedal it hums if I'm around 50mph, also when engine braking around the same speed it hums too, pitch changes with speed.

Took it back a few times, lots of fobbing off excuses and fake investigations, asked a Skoda tech for their opinion they said flywheel, I took it back to my garage, suddenly I'm getting a bad feeling.

They start throwing in the "it's been remapped" line, I say balls it happened as soon as I drove it away from the garage, it's a new problem, they should fix it, they say it can't be the clutch and even if it was, they told the clutch supplier that my car had been remapped and now they're saying it's not under warranty and they refuse to touch it.

They're now saying they're going to talk to the supplier again, but I'm almost certain this is just more fobbing off.

So, 3 questions:

1. Do you agree that it's the flywheel? I think it's a bit weird it's only happening in 5th, I was expecting gearbox

2. If it is the gearbox, could they have done something wrong during clutch fitting to break it?

3. If the garage do try and worm out of it do I have any legal recourse? it's been a while since the work was done due to delays and fob-offs, and I don't know if modifying the car has affected my rights when it comes to parts warranties

If they are refusing to look at it, the best you could do is get an independant vehicle inspection. then you have some evidence of what the problems actually is.

Id say they are obliged to look at it if you reported the problem straight after it occured.

They've already 'looked' at it, they say it isn't the flywheel as it isn't happening in every gear, Skoda guy says it is, I kinda agree with my garage on that but I have to go with the expert.

Even if it isn't the flywheel, the problem started happening between me dropping the car off for the new clutch+flywheel and me picking it up. I pointed this out and all they do is say "yeah it's a mystery" and "there's not much you can do wrong swapping a clutch"
