Warranty work, exactly who's responsible?

Featured Replies

My Fabia is 9 months old and has had a fault from new. The faulty part has recently been replaced under warranty, however, the repair is not of a satisfactory quality. The dealership who carried out the repair have proven to be totally useless beyond belief, not bothering to return my calls even though I have endeavoured to contact them on numerous occasions to discuss the faults.

The question is, legally who is responsible for resolving this deficient repair, the Dealer, or Skoda? When you consider that I didn't actually buy the services of the Dealer to repair the car, and that the Skoda warranty includes supplying and fitting of parts, I feel that Skoda are responsible to ensure a satisfactory repair to the correct specification, and to a reasonable standard of quality. The warranty surely is a contract between Skoda and myself as the consumer. What do you think?

The warranty should be upheld by Skoda UK regardless of the dealership if its a warranty claim...contact Skoda UK if you are having problems with a dealer..(assuming its a Skoda dealer that you are having problems with) they should point you in the right direction

Thanks for the replies. I noted in the DTI link that........

Q3. I have had my car serviced or repaired and I do not believe the job has been done properly. The repairer is refusing to do anything about it, what are my rights?

Supply of Goods and Services legislation requires a trader to provide a service with reasonable care and skill. Any materials or parts supplied must be of satisfactory quality.

If a trader fails to observe these requirements the law treats the matter as breach of contract and, if necessary, a consumer can pursue the matter through the courts.

In this case surely a contract between myself and the Dealer never existed because the warranty work was financed by Skoda, so the contract for services must exist between Skoda and the Dealer. Where does this leave me?

BTW, the dealer involved is a Skoda dealership.
