I had an accident march 2013, long story short i was using slip road off the m1 correctly and was following the lane as it drifted left, a car that decided it didnt want to queue was using the hard should of the same slip road and collided with me where the hard shoulder ended aa the lane i was in veeres across it.

Insurance paid for their damages and had their car fixed 2 months before anyone was sent to look at mine, all because someone misunderstood the details i gave over the phone. After complaining my insurance company looked back on the details and realised they had messed up.

A year later and they were having trouble getting third party to admit fault, I phoned up today as I have not heard anything since march to find out the only development is that in april this year the two passengers in the third party car have claimed whiplash.

How can anybody claim whiplash for an accident that happened the year before? They didnt go to the doctors at the time of the accident but apparently they are going to be sent for a mesical soon.

I just laughed down the phone at the insurance people and asked how they can even be entertaining this and waa told its how the system works.

I had loads of calls asking if i was injured at the time and i said no I just want my car fixing, it just goes to show you get nothing by being honest in this world.

To my memory, examples like this came up in the news last year when the Houses started talking about sorting out insurance law, but I don't think anything came of it.

One of the main issues being looked into was the way things keep being added on to bump up insurance prices, but thrown in their was the expense of whiplash claims where no evidence is ever required.  IIRC, a few peers suggested that more stringent guideleines should be brought into place that would include medical proof for whiplash, but the counter argument that whiplash is almost impossible to prove and easy to fake killed the whole thing.

 

Some people are just ar**holes I'm afraid.  With any luck some karma will swing their way and they might get to find out what whiplash is actually like.

Sorry to hear about your ongoing problems. It's another case that shows good reason to invest in a dashcam as people often have selective memories when it comes to admitting liability and often change their mind if they think there's something in it for them or tney can get off. The insurers arn't really interested in you or your circumstances I'm afraid and unless you have proof you stand little chance of resolving it, mostly I guess because they are too used to being lied to (no suggestion you are I hasten to add) but it's also about the 'bigger picture' for them in keeping costs down and profits up. +1 on the cam. In the event I wouldn't even point out I have it and if the person decides to try and make a fraudulent claim, then I would do my best to get them bent over and receive the long fist of the law. "Oh wait a moment..... I forgot I have it all on camera, silly me" 

Dashcam footage would need to be kept for 6 years, as a claim for damages can be made up to 6 years after the incident.

Regarding the dash cams, which ones are the best? I'd like one that would play on my iphone or ipad as well as my PC, and is very discrete and easy to turn off as we aren't supposed to have the on at work, so I'd need to turn it off before I entered the car park/yard.

You could always threaten them with a solicitor, say you were not in the wrong, have had enough, and you are now going to claim for costs incurred due to their incompetence and delaying tactics. If they think it is going to cost them money they will soon sort it out...

Thanks for all your advice after all the trouble and from what ive seen with other people a dash cam might be a good idea. Sad state of afairs when it comes to that.

Insurance has realised its going to cost them now even if it goes 50/50 they will lose money on it they lose less money if i close the case, they say close as if its something simple but they dont tell you by closing you admit fault unless you ask. my friend who used to work for norwich union legal said go to umbudsman as insurance has to pay for that too.
