You crossed the lane and caused the incident, wether you actually meant to or not. I have been in exactly the same situation as you and come out a lot worse than 50:50. Oh and don't rely on your legal team to help you, they don't assist if they think there is a chance you will lose.

The other driver was lost and just going round hoping to find the correct exit then you cut her up. We've all been there.

From what I read, the clio seems to be at fault by turning right in the left hand lane, the angles of impact also seems to indicate to me that she didn't check blindspot or mirror.

If there were clear signals on the approach to the roundabout allowing you to proceed straight over the roundabout from the right hand lane then you may have a shot at escaping liability, however if there were no such road markings/signs I would have to say it's likely to be 50/50. Remember also that in order to avoid the loss of your NCD you will have to be cleared of all liability whatsoever, even a 1% finding of liability on your part would mean the loss of the NCD. A lot simply comes down to who gives the most credible explanation of events in court, I assume there were no independent witness statements.

The Clio was continuing around the roundabout in the LH lane, not turning right. Drivers often do this when they are not sure which exit to take. You changed lanes to exit the roundabout and collided with the Clio, not vice versa. Reluctantly I am with the insurers on this one and have voted 50:50.

I was torn between you being at fault or 50:50.

If it was my decision, I'd say it was your fault however, I reckon the insurance will go 50:50 so that is how I voted.

I voted 50:50 as well although I dont know the exact circumstances, or the presence of any road markings on the approach to/exit from the roundabout or if the other party had their indicator on. If the later then you should have made allowances for what was happening, if they say they did have them on then (even if they were off) it will go 50:50. My brother had an accident a few years ago, he was waiting to turn right into a space on the right side of the road when the car 2 behind decided to overtake just as he started across the road. That went 50:50 as the other driver claimed he wasnt indicating, the indicator lever was on and the lights flashing but they claimed he turned them on after the crash.

Perhaps my wife who had a 50:50 in the same circumstance wasn't a "lucky b****r" or "100% her fault" (quote MarkyMarkD) after all. See original thread.

I voice my certainty for a good reason. I've been there and done that. I looked the plum in front of the judge when she asked if I looked while changing lane from right to left, when I said no, she replied 'So you didn't have full control of your vehicle? Should I add that?' I still remember it and that was a few years back now.
