I've not been a customer of yours for a while now, but last week I get a random text asking me if I would consider using you for my insurance in the future. Given you were unable to offer insurance at anything like a competitive level being the reason I left then I find this rather strange.

In line with GDPR I'd like you to remove my details from your database for all purposes related to marketing, and any previous consent to use my details is now withdrawn.

I did try and call you on this issue but the person I spoke to was unwilling or unable to assist and put me in a queue where I waited for some 30 minutes before giving up.

No doubt you'll need to contact me to find my personal details, and that would be acceptable via PM on the site here.

Actual text says...

 

"You took your car insurance away from us last year. Please try us again and receive £20 OFF our best rate. Call 08009172274 - QUOTE CODE 999"

 

And below that a system generated note saying "Sender does not support replies".

I'm pretty sure that's actually in breach of the GDPR then, and you should contact the Information Commissioner's Office for better qualified advice than I can give.

Under GDPR consent is not required where there's a client/contract relationship. GDPR allows us to rely on legitimate interests as the legal basis for processing data instead.

 

Customers do of course still have the right to request that processing ceases at any time (which you have now done).

 

In any case, we'll only contact customers on the one year anniversary of their policy lapsing and then processing ceases automatically.  If you can supply some information so we can identify you on our systems we'll action your request explicitly as a 'belt and braces' measure.

Correct, but my understanding from post #1 was that Rustynuts had terminated that relationship.

Indeed, which was the initial irritation which prompted this.

The question is whether, under 'Legitimate Interests', it is reasonable for a data subject to expect contact following a previous, recent relationship. In our view contact at the one-year anniversary of the expiry of a one-year policy is reasonable and to be expected. It would however be unreasonable for contact to continue beyond that.

Reasonable is subjective. If I punched someone in the face and then a year later I sent them a birthday card, would that be any less reasonable than sending one two years later?

Personally, my view is that marketing is a necessary evil which should be (and now is) in the hands of the customer to accept or refuse. As we are now, I'm confident I'm no longer going to receve marketing or invitations from Chris Knott, so that concludes the issue.
