EGR alarm 4 days after warranty expiration. Now what?

I am driving a 2010 Superb Estate, 2.0 tdi CR 170 with approx 135k miles on the counter

 

6 Days ago, after 90min in a long drive dashboard suddenly showed the yellow exhaust warning light.  When the light came on, I did not notice any difference in  engine behaviour,  Fuel consumption remained within normal limits, if not improved a little (could also be the wamer weather in Scotland the last days . The radiator temps remained normal, oil temps same, and I could not register any excessive noise or smokes during driving, or rough idling. 

 

4 Days ago I connect one of these ODB2 tools to the car, only to learn that the EGR valve is stuck in open position.  With engine switched one but parked, I read approx 40-45% open for 800 rpm, but once rpm increases to 1500 the valve opens to 90-100%. From what I understand reading on the forum, the valve should be closed at low RPM. Is this correct?

 

A few days I booked in the car at my local independent garage, to check the valve for issues later next week.    However, during the weekend, I learned that the warning light came up exactly 2 years and 4 days after the emission fix for VW engines. My car had this fix, and the paperwork states that there is a 2y warranty on EGR failures after the fix.  The paperwork also states that any damages as a result of the emissions fix will be dealt with under goodwill.  So how do I prove that the EGR failed because of this fix, especially given the car has done 135k miles and what is best tactic to approach the SKODA garage to get this freebie?   I want to avoid that I drop the car of in their garage, and then be footed with a 1000£ bill for the parts + labour and some extra for the diagnostics that I have done myself.

The best bet is to get it booked in at your local dealer for an inspection. They will be able to advise if it is covered or not under the terms of the EGR goodwill.
