On last day of holiday, visited Boscastle, Cornwall. Very pretty. Got carried away, took lots of pics and arrived back late in council park and purchased further ticket to cover remainder of stay. Returned to car to find I'd been issued with an Excess Charge notice for the overstay -the usual

Just pay the fine - you're in the wrong and I can only see an appeal costing you more money :D

The thing is that the Excess Charge Notice was issued at 16.30 (Handwritten) and the second ticket I purchased started at 16:32 (machine printed) - can't be sure that warden time was synchronised with parking machine time.

Unfortunately, it's fairly common practice for traffic wardens to check the time on the machine when they arrive at a car park, and syncronise accordingly.

If you appealed it, on what grounds would you justify not needing to pay the fine? I'm not sure if "I was two minutes late" would be a good enough justification to be honest...

I would appeal. For the sake of a stamp and 20 minutes writing a letter I think its worth a try! I've had 2 parking tickets in my life and both have been revoked when I appealed!

I wouldn't bother appealing, just stump up the £35 and put it down to experience.

What time had the first ticket expired?

I would guess its the period between then and when you got the Excess Charge Notice at 16:30 that will be classed as any "grace" period.

You don't say when the ticket that was on the car when you were issued the notice expired. I think that's more important than when you bought the new ticket as I suspect the warden did give you a period of grace of more than 2mins.

Good job you weren't in that car park about 2 years ago. :eek: I would pay the fine to be honest. :)

You don't say what time your original ticket expired. However, they could also ticket you for "feeding" the meter, as most car parks/meters have a minimum time before return (ie you must leave the car park and only return to park after the alloted minimum time which is usually 1 hour.) Thus buying a follow on ticket could be classed as feeding the meter. Most councils have their wardens routinely log reg numbers as they go around, thus making note of your presence.

Pay up and take it on the chin.
