What to do when Ebay goes wrong?

I am looking for some help, my uncle has just bought some wings for his Sunbeam from Ebay, he payed via Paypal.

He has now recived the wings, but they are useless, beyond repair and therefore no good. So he is going to go to the seller, but I have a feeling that the seller is just going to turn around and say tough luck mate.

From this I assume that it is best to go through and report him to Ebay, but is it possible to get our money back via paypal, and if so how do we go about it?

Just wipped this off the Paypal website;

You can open a dispute in the Resolution Centre within 45 calendar days of payment. By opening a dispute, you are able to communicate directly with your seller to work out a problem transaction.

If you and your seller are unable to agree on a solution, you must escalate the dispute to a PayPal claim within 20 calendar days of the date the dispute was opened. By escalating to a claim, you would be asking PayPal to review the case and decide the outcome.

From experience as both a seller and buyer, Paypal tends to side with the buyer so if the guy won't give you a refund, Paypal will probably give you a refund (not for postage though)

Once you're successful getting your money back I'd email the seller and offer to return the item if he pays the cost of postage(whatever he charged your dad for postage). If he won't pay, keep them (or throw them!)

If Paypal don't refund then you can try the small claims court. Did this last year and got all my money back plus expenses.

you can also take a case to ebay/paypal if the item as misrepresented.. ie: seller says the are 'new' and the obvoiusly aren't new

The pictures then show what appears to be a pair of wings in very reasonable condition.

The ones that my uncle recived are rusty, and damaged. The wings pictured show no signs of the rust that is present on these, and I would never describe a panel as good if it has any signs of rust.

So sepending upon what the seller comes back with, we will take the dispute to ebay and paypal and see what happens form there.

Em, depending on the age of Sunbeam we're talking, and the extent and seriousness of any rust, they might be good in the "as good as you'll find going spare" sense of good.

Have you got any pics of the wings "as received".

You might get better advice if we are able to compare these with those shown in the Ebay listing.

In the first instance, why not just email the seller and politely point out that the items aren't as described, and that you'd like a refund. If he's an honest bloke, he'll give you one.

If he refuses, say you're going to raise a dispute via Paypal -this will often push them into giving the refund.

If not -go to Paypal. You've got a very good case, if the items weren't as described.

This happned to me when I bought a model train.Came not as described, sent three E Mails to the seller who didnt answer, then informed him that I was sending the complaint to E Bay. No reply so sent the complaint. The seller informed me that E Bay had contacted him,and suppose of fear of being removed from E Bay sent me a full refund and also told me to keep the train. So contact seller inform E Bay of the compaint and wait and see.

Cheers for that the seller is the first point of contact, its not really fair to go straight in with Ebay/paypal. I will try and get some pics up soon, i have to go across and see them first.

Ill let you know what happens.
