Hi lads, wonder if i can have some advice!

I've recently bought a Seat Ibiza Cupra TDI, it's had 1 owner FSH, 27k and was from a dealers in walsall. They had the car in part ex for something else as it's usually a fiat/peugeot dealership.

I picked up the car on Saturday morning and all was supposedly ok, the car had had a full service and a fresh 12 months MOT when i got it.

On Sunday morning i reversed the car off the drive to find a nice patch of black oil under the car, upon inspection there appears to be an oil leak! I spoke with them on Monday morning and the earliest they could get me in was today to have a look at it. I've dropped the car off as they thought it was just something that hadn't been tightened correctly and waited........i waited for an hour for the woman to then come and tell me they think it's either the turbo or the turbo seals! When i asked who was going to have to pay for this she told me it "should" be sales but would have to get back to me.

Being as i've only had the car 3 days should i just give it back to them and say i don't want it, after all what else could go wrong? If so how would i stand with this as the car is on finance. Either that or i could just get it repaired and make sure they pay for it and keep it in the hope that nothing else goes wrong

What should i do?

Insist they repair it . The car clearly was not fit for purpose and as such consumer law says that at the least the suppliers should either repair it or refund your money. If there's any hassle tell them you'll be referring the matter to the local Dept trade & industry and if need be get someone else to fix it and then take out a small claims court action to recover this cost. .

As above, you're definitely entitled to a full repair using VAG OEM parts, and the corresponding 12 months warranty on same I think.

I just think you have been unlucky, I don't think any car is free from faults (I have even seen a Rolls Royce on the back of a AA Truck)

The only thing I would have done is got them to pick it up (not drive it) although if the turbo had gone I thing you would have known

about it, but driving it with no (or little) oil could have done a lot more damage.

And I would not have even asked who is paying 3 days at home thats down to them.

You say it was a main dealer (not Seat) what warranty did they give you ?

I would ask for a loan car till it is fixed, and then try it for a couple of weeks, and if there is still a problem take it back and say

its unfit for purpose, and demand your money back, and if they say no, take them to a Small claims court

Thanks for the replies everyone, I have a curtsy car they gave me but I don't intend on using it past today (excess is £1500!!).

I can't remember what warranty was agreed until i get home and check the papers out, although i should have thought at least 3 months! I'm in the process of writing letters to both the owner of the dealership and the regional owner detailing the what has happened over the last 3 days and will send it recorded delivery tomorrow if needs be.

I'm just worried that they could fix it and then something else could go wrong in 6 months time that's also huge and I'll be buggered!

No warranty required, the goods are not fit for purpose and your statutory rights as a consumer kick in.

Car was sold as working, it does not.

In terms of warranty, look up warranty direct.

also, if its within 14 days your finance company by law has a "cooling off" period, where you can cancel the deal, must be within 14 days of signing though, then you can just hand it back.......

personally i like the car, i'd let 'em repair it, assuming they do a good job!

As you say, assuming they do a good job! I just hope they don't try and use reconditioned parts if it is the turbo.

Depending on who does the recon, that can be better than new.

In some cases it might not be, but I'd certainly be looking at where the leak has come from.

Oh dear, that didn't last long , did it. As you bought it from a Fiat dealer they must have given you a warranty and I can't see a main dealer using recon parts to fix your Ibiza, don't panic yet.

Maybe they just haven't tightened up the sump plug securely. Might be something simple, yet annoying for you!

I thought that might be the case, but i waited for 2 hours whilst they checked the car and then came back and said it would be a few days before i could have it back and they thought it was the turbo. I really hope it's not anything that is going to cause me problems in the future!

:dull: What do you expect from a fiat/peugeot dealer?? They don't even sell decent new cars :giggle:

The finance company have as much liability as the supplying dealer. Contact them they will also have more clout with the dealer than one single customer. Maybe could persuade them to have it fixed at a VAG garage?

As others have said the car is not fit for purpose.

If I was you I would get them to pay for an inspection by RAC/AA etc so that you have peace of mind from a third party ( that's if the garage don't already do that. If they do ask to see the report)

I would also speak to the finance company as has been suggested if the outcome is not to your satisfaction.

I'd also be concerned about that dealer! If the car has leaked oil all over your drive after sitting for only one night, there's no way it also didn't leak oil all over the dealer's forecourt while sat idle. And nobody noticed? You might want to check they don't also use the same blind employees to fix the leak!!!

Update, been to the garage and collected the car today. The mechanic who did the car wasn't available as he was on lunch (typical!)

The woman on reception said a pipe had apparently split but couldn't tell me where? It's been road tested and the like and no oil leaking at the min. Drove it back to work and it felt much better, will keep an eye on it over the next few days and see what happens!

Thanks for the advice everyone, i didn't pay a bean and they never asked any way lol
