Just spoke to the bmw lot and they said do whatever.

So insurance it is and my girlfriend did wake up with achey back and stiff neck.

Should she claim??

You must get up to a doctor/hospital and get checked out first of all.

Otherwise there is no proof it occured due to an accident.

I'd just see how it all feels, mention it to your insurance co so they know there is a possibility and see what the doctors say and how the pain goes.

Also in terms of CCTV, I'd get that evidence sooner rather than later because they tend to re-use tapes.

To sum up.

We went through the insurance. Car is going into garage Thursday for possibly a week to be repaired.

They recon the total cost for the insurance to pay out is around 2,300 odd :S

To look at the damage though you'll never expect it to be that bad.

It's going to a crash specialist garage so I suppose the car will come out of there gap free etc, rear wheels lined up tidy and so on, even though car drives faultless but they check for miss alignment any way.

Misses went for check on her neck and they confirmed that it is whiplash. They also x-rayed her to check for bone damage but thankfully it's just muscle soreness. Expected to get worse for her in the next six weeks.

Doctor give her an 'Accident Claim' number to ring. (I thought that was funny at the time, as her doctor suddenly turned into a wanna be solicitor) :giggle: . Change of career perhaps.

IF ANY ONE OF YOU HAS SOMEONE CRASH INTO YOU AND THEY SAY "I'LL PAY FOR IT, LETS GO PRIVATE."

TAKE MY ADVISE AND TELL THEM TO F**K OFF!! It's not worth the stress of waiting for them to see what they're going to do about it and they'll hang you out for as long as they can.

Honestly we're in bloody bits over this bloody crash.

When they offer to do that, it is blatantly obvious they are hiding something. Hope your missus gets well soon.

I had somebody reverse into my Octy vRS about a year ago, drumpled the front wing, into the bonnet etc.

Old fella gets out and says "I wondered why my parking sensors were beeping so much".

Anyway, turns out he already has quite a high premium because he's old and wants to go private.

I take the car to local main dealer and they give me a quote - £600.

I ring the guy up - I could hear him choking on his cornflakes!

I gave him the number of the main dealerm he called them and managed to negotiate down to £500.

My car went in, I paid and he Bank Transferred the money to me the same day.

Everything went well - my work was top notch and no problems arose - so it can be done!

However, at no point was I not going to take it tot he main dealer.

The guy hit me, I am in control not him.

If he had said no to £600 (£500) and said he wanted a local garage to look I would have just said "OK, insurance time".

I know it will affect you too - a non-fault claim.

But at the end of the day the important thing is that the car is repaired to a good standard and that means paying the money.

It doesn't help that I'm ultra fussy.

Her car was bought exactly how we wanted it. Xp pack, bigger wheels, colour, engine size etc.

Someone else damaged our car at the end of the day and that car won't be coming out of the garage until it's mint.

I know all about blending the new paint in with old, cheap laquer game to rush the work, Orange peal effect, different size gaps in panels and so on.

I hope for their sake they take they're time with it.

I forgot to mention that our car has a completely smashed back door and rear quarter, side skirt cracked and come away and inside all the metal had bent in on the sill.

Just to offer a bit of balance, my wife ran into the back of one of the neighbours last winter. Not too much damage as it was a very slow impact. Rather than claim on her insurance, I got them to get a quote for repair at a place of their choosing, then I paid over the phone for it to be done. The quote was just less than our excess.

Actually, if anyone got screwed, I suspect it was me! I never got any paperwork following the "repair". The principle cost was replacing OE reversing sensor which got broken. But I never got any confirmation of the actual cost before paying up.

This was a mistake, looking back. We were happy not to have the minimal damage to our car repaired, so had I put it through the insurance we wouldn't have paid the excess as it turns out. We would have had an increased premium though....and (can't remember who it was) but someone made a good point about informing the insurance company about something that "may" result in a claim.
