Misses got smashed into by another car!

Yesterday my girl friend was driving along and a BMW X6 (bloody great big monster thing) smashed into the side of her (57' plate Corsa) trying to pull into a junction.

Clearly didn't see my misses in her normal size car!!

BMW driver admitted it was her fault straight away. No problems there then, but they want to go private and won't except the quotes I've gathered for them to pay.

They want to take it to they're garage they usually use!

But I want our car in the body shop that we want to use???

What right's have I got??

They said they can get it done cheaper with them but I don't trust the work to be done there!!

Insurance all the way.

There must be a reason for them to go private, it's not because it suits you best.

Sounds like they'll get a cheaper job done by a mates garage or something and you'll have no comebacks once the repair is done.

It's not about them getting it done for the cheapest price, it's ALL about getting it done to YOUR satisfaction.

Are they even insured?

I've told them and told them that I want it done in the garage of our choice and they just won't except it! It's driving me mad, they said that they're gonna get they're garrage to have a look at it, I've said no but they're insisting it will be fine, what can/shall I do next?

They're bmw x6 is worth about 50-60 grand by the way.

IMHO two options

- If it was slow and your wife is certain she was not hurt, then you get her to put it in writing that she accepts it and you tell her that she will accept one of your quotes or you're happy to go via insurance.

- If you are not 100% sure you are not hurt, or the speed was not very low, or you're happier this way then go via the insurance end of story. You don't need her insurance co, just a name, description and reg plate will be enough for your ins company to trace her.

Personally becuase this driver seems to think they can refuse the quote, I'd be going through the insurance (Assuming they actually have any). On that note, make sure you have an address for the driver and then get your insurance company to confirm she is insured.

If she isn't insured, you can still go after her in the civil courts for very little outlay and get the cost of repair and the rest.

Oh and if she isn't get the police involved straight away.

ask for the insurance details and go through that. Why should you do them a favour after all they should have been more careful. You've got no comeback if the garage does a bodge job if it's done privately.

We had the same problem when someone drove into the side of my misses polo. Being an N reg it would have been written of.....It only needed two doors which I found at my local scrappers in the colour of the car. However the guy wouldn't pay what they cost because he said he'd found two doors (totally wrong colour as well and one rusty) for less than a 1/4 of the price.

Anyway he wouldn't pay up so I said fine we'll go through insurance. Then he wouldn't give us the details and when I checked on askmid.... the car he was in wasn't even his. He'd "borrowed" from his sister. So another phonecall to him saying I was phoning the police and his sister's insurance company and low and behold an envelope with cash covering the doors and an extra £100 we'd never even asked for arrived through our letterbox.

i would be straight on the phone to your insurers.

mmmmmmm.........Sounds a bit doggy to me, may be the X6 driver wasn't Insured, not her car or has a hat full of points. Or.......she has a large excess and can't afford another bump

Is she seriously injured, or are you just trying to get more money out of the BMW driver? Don't forget, we all suffer come renewal time for inflated claims. If she's genuinely injured and has to have time off work, needs treatment, can't get to the shops, etc., then she probably should. Otherwise, bad joujou'll come back to bite you and her on the a55 when you come to renew in a couple of year's time B)

Definately get it checked out - i was involved in an accident in 1996 - in the back seat and slow impact, went to docs about a month after and only got £600....but have suffered with my back ever since. so the moral of the story is, get it check and get it physio'd! Whiplash etc doesn't always show symptoms straight away so may get worse. Not saying to go to claim £'s, just don't suffer like i have! :thumbup:

Yes she should. They jerked you around, so get searching online for a local solicitor that specialises in accident claims, and don't use one of the big boys. The small indie solicitors can often be like rabid pit bulls and wont let go...

Tell the insurance first that she believes she is suffering pains as a result of the accident. They will arrange physio, you may need to go to docs first though but the insurers will advise. Don't waste yours or the hospitals time by going there as they won't do anything anyway!

Ok. Thanks for your advice everyone. These past 2 days have been dark days for us, it's crazy how something like this all be it not that big a bump can shake you up emotionally.

I'll report back of outcome in next few hours/days.

Been there, done that, the wife still suffers from shoulder pains 6 years later... Get yourself and your wife to your GP and get it checked out. If it is related to the accident (which it likely is) then the sooner you start physio the sooner the pain will go away and the likelyhood of problems later on is reduced. Your GP will be able to refer you to a physio and write a letter to your insurers with any relevant information about injuries.

The next couple of weeks will be tought but things will get easier as time goes on.

Sorry if I sounded unsympathetic before, but you can't deny there are too many people willing to try it on for an easy buck. Sorry :(

She should definitely get checked out by a GP first, and then maybe he/she will refer her to a physio. She should also try Arnica oil. It's a miracle worker for strains and bruises.

I hope it all works out for you, and she makes a full recovery :thumbup:

Anyway, just got in from hospital (now 12 o'clock at night). Misses went in at 7.30ish and she didn't get seen by a doctor. Waiting room was absolutely packed. They told her at 10 ish (after waiting 2 and a half hours) that she'll have to wait another 4 hours!!! So I went to see her what's happening dragging my 2 kids with me and she looked drained. She hasn't ate since the bump, her neck has just froze now and she'd been standing up all this time as all the seats were taken.

Got her from there and she got to go back up in the morning to still wait for doc.

Prince Charles hospital a&e! What a messy system you have!!!!!!!

Not all insurance shows up on askmid, I've read a few topics/posts on various forums over the years with people saying they went onto askmid and there car/bike showed up as not being insured when it was.

Same thing happened with my mate, askmid showed his car not to be insured so a quick phone call to the insurance and it was insured.

Hope things get sorted and work out ok :thumbup:

trade policies tend not to show up on askmid. I've not yet had a privately insured car not appear on that link. Very handy.

Whats betting the BMW conveniantly remembers it was your gf that ran into her when the insurance start sniffing. Did she have any independant witnesses?

I'd let the insurance company settle it to be honest. Least you have some comeback if your unhappy with the work done by the approved repairer.

Postmanpat- the crash is on cctv if needed.

By fluke there's one live cam in our area and it's right on the bend where it happened.
