I find a chalk pen, on the windows cause enough problem.

Nothing permanent, I don't think it's criminal damage, but enough to annoy the cr*p out of them.

After sending an e-mail to our local superintentant this morning asking if failing to stop after an accident and refusing to give details was still an offence,he replied to me this afternoon saying that the road traffic unit are now looking into this incident.

He also gave me drivers name and address :giggle:

So they should.

Recieved a letter this morning from Hampshires finest to say they will not be taking any action regards the other vehicle not stopping and refusing to exchange

details.So it seems we can all do as we please now as the law can't be bothered. :@

Un-F***king-believable. Don't suppose they could ascertain if he was speeding or not as this seems to be all they are interested in.

If they could be bothered it would be driving without due care and failure to stop which is 3-9 points for the due care and up to £2.5k fine and 5-10 points for failure to stop with up to £5k fine and up to 6 months imprisonment.

Both of these offenses involve court so i would imagine this is why 'no further action' will be taken.

Its about time the law was enforced on things like this....you only have to watch an episode of traffic cops to see that people get off with everything.

If you look at the likelihood of a successful prosecution in this case it is nil.

Two participants who will not agree what happened.

No independent witnesses.

What is the point of wasting public money in persuing it?

How good a statement was the van driver willing to make?

It's the balance of probability, not reasonable doubt.

A judge could still find a private prosecution in favour of you.

Otherwise why would you have her details, why would you have persued the police etc etc?

There comes a point when you have to make these people realise they can't just get away with it.

Personally however, I'd have got a new mirror, then sued her privately.

Without seeing/knowing the story from both sides I make the assumtion that you both saw a gap and decided to proceed only to find it wasn't as big as you thought and both thought the other driver was in the wrong and should stop/move over some more.

Put it down to experience and move on. A woman cut a country corner when SWMBO was driving my old Octavia and SWMBO moved over as best she could, my car ended up with scratches from the hedge on every panel on the left of the car and the drivers door mirror was also knocked off by the woman in her BMW. SWMBO couldn't get turned round and the woman didn't stop. The local police force refused to investigate as all SWMBO could say was it was a silver BMW with a woman with dark hair driving, no witnesses/CCTV or anything, on a postive note I saw the car/woman a few days later driving down the same road and when followed I inspected her drivers mirror and the paint was a match :) she admitted to causing the accident as it had been playing on her mind and she felt guilty for leaving the scene, she then agreed to cover the costs if I didn't claim on her insurance.

Being vindictive is a natural reaction but not one that should be acted upon

A few cloth nails either side wheel if unsure which way it will go. For more Joy park in the spare space front or behind sit and wait and watch it run down to the rims. 4 Flat tyres stuck in a car park with a load of shopping. Did not think of this, trawl the car park till you see it again.

Oh, to put some useful info into my post I suppose I should say this is an INCIDENT rather than ACCIDENT, unless you mean no one is at fault.

Why did you even try to play chicken in the first place?? I personally don't have the time/hassle/effort/money to follow though if such things or worse happens. If your answer is similar to the list above don't bother replying.

Why do you presume I was playing chicken.Do you think I would put my wife,myself, and my car car at risk by playing games.I had the right of way and assumed the oncoming car would stop.when she decided to ram her way through I pulled as far over to the kerb as I could without mounting the kerb.,and please next time do put some useful info into your post or don't bother.

How would you know its not useful info if you didnt even read it properly?

Just because a road user is supposed to do something doesn't mean they have to, need to or will actually do. Hows that for another useful advice?

In your situation I would not assume anything until they actually stopped or very apparently slowing down to stop, then i'll say thanks when im going past, again enforcing the 'its not a right' point in my previous post. I would not change much in my attitude towards other drivers when I have passengers in the car or not. I.e. I don't drive like a t*t on my own with other road users round (though driving like a t*t on my own on an empty road is a high possibility).

Oh to answer your rhetorical question - I assumed you play chicken because you chose not to leave enough space for a car to get though without something being damaged regardless of "right of way". Your not learning to pass your driving test, you (I assume) actually passed now and the aim is ideally to drive to the laws, but essentially avoid incidents by incompetent drivers who think 'they are right'.

1/ There is no such thing as "right of way" when two cars are approaching each other, unless there are markings on the road to confirm such.

2/ Assume = "ass of you and me" Never make assumptions!

I was not trying to goad you, I was pointing out that in your situation that there is no such thing as a "right of way", and that making assumptions can be the wrong thing to do.

Ok so he didn't have right of way but she had the obligation to stop and wait as the obstruction was on her side... same thing just put in a different way. Still means she should have stopped.

Sorry to hear this happened. And really sad to hear people can be so ignorant. I had a similar thing where the other person denied all responsibility and refused to give details... I left it as I only had a little scrape on my plastic rub strip on the front whereas she had a big dent and scrape down the side of the car (fairly new golf). I just said "Fine. You want to play it like that? Then have fun fixing your car... it will cost a lot more than mine to fix!" She didn't look pleased but she made her bed and I made her lie in it!

Shame that the woman who hit you hadn't smashed her mirror too... There's time yet though! lol

Agreed, but it goes to prove that assuming someone is going to do something can be both dangerous and expensive!

After nearly 6 months I finaly recieved a cheque this morning for my excess plus interest.My claim was passed to RAC legal dept and then onto a solicitor who threatened legal action.RESULT :rofl:

Good news, just a shame it had to take so long.
