HI there apologies if this tread is in a wrong place.

I'm new to to this forum and was wondering if you could give me some advise.

Let my story begin;) ;/

Afer months researching internet I have found beautiful Skoda Octavia vRS in Black- wne to a car garage in Essex spoke to sales person and agreed sale.

That was last saturday.

Car wasn't tax and was going to be delivered on a lorry on Monday- and it was- without a road tax.

There was a note in ''apologies ther car will be taxed today and road tax disc posted to you 1st class 2moro''.

Ok fine.

Now.

The problem i have got is.... today is wednesday and the road tax arrived and I have had a phone call from a dealer sstating that they have problem with log book and had to apply and can't get tax.

So conclusion... got a car on a drive with insurance and MOT but no tax so can't use it!!!!!!

The other car I've got goes to the garage( body shop) for valuation for insurance claim and possibly will be a write off.

No it would not be a problem if my wife would be due to give birth in aproxiamtely 1 week time...

Skoda should be on a road from Monday 04/03/13 and its not.

ufff... I've almost finished....

Now the question is there any chance a can claim costs of my expenses from the garage for the inconvinience?

They have made promises and nothing happened and I will have to hire a car on the 11/03/13 to keep mobile (my insurance doesnt supply curtesy car becouse claim is 50/50- on the roundboud funny enough).

Please help with some advise

Phone the DVLA, check the vehicles status. I assume you have a receipt/ bill of sale etc? V5's can be replaced. Did you do a HPI check? Did it feel like a 'got a right bargain here' purchase?

I have done HPI( its clean - I have got receipt and rest of the paper work done checks and even traced lease company who owned this car and auction house which sold it to the dealer, but apparently log book was lost so now dealer is applying for the V5C and tax for me it is just sooo frustrating that they told me I will get tax yesteday and nothing happened.

The peice was acurate for the year and mileage not a bargin- they are very apologetic that they messed it up

My sisters partner had a simillar scenario, in that they bought a car without V5 since it went through Auction. The car was taxed but only had a couple of weeks left, the tax run out and still no V5 despite the dealer applying for it. She basically phoned the DVLA, and after confirming some details they did something on their computer system and issued her with a document ref that she could use to tax the car online and have the tax sent to her address.

For a car bought without a V5 it can take six to eight weeks for the V5 to be processed, this is because the DVLA write to the previous keeper to confirm they sold the car. If they respond and say yes its all ok the V5 is issues, but if they fail to respond then the DVLA will not issue a V5 until six weeks after they ask the previous keeper.

Your best bet is do as she did and speak to the DVLA on the phone, they can sort it so that you can tax it as long as you have some other documentation like the MOTs and a VAT registered garage receipt.

Thanks Mannyo. I will do that tomorrow. I just can not belive it. Got a car and can't use it what a pain. I just wonder why dealer didn't get V5C prior to adversising a car...??

Its day 15 with me having my vRs sitting on my drive.

I have contacted dealers and thats wat they have responded:

I have bought a car from yourselves on Saturday 02/03/2013.

As discussed sorry for this issue on our part, it is un acceptable although out of our control.

As discussed on the phone I will re-imburse the cost of the tax for you.

I will also contribute to your hire car cost at a rate of £100 per week for a maximum of 2 weeks.

I hope this clears the issue and we get you on the road in your own car asap.

Good afternoon

I just wanted to get some update regarding my tax and log book.

We are approaching fast the beginning of third week of me having a car without a tax and log book.

I confirm that I don't accept your offers of reimbursing tax and contribution to car hire.

You need to put me in a position of redress meaning that not only should you be reimbursing all of my outgoings in full you should also consider compensation payment in consideration of the inconvenience you've caused me.

I have rented a basic car for 6 days this week (VW Polo 1.2) for the amount of £107.02 + £69 Insurance cost.

I will require extension to hire for minimum of further 8 days as I have to travel to hospital to see my wife who has just given birth. It is 70miles round trip and she will be in hospital for the next week.

The cost of hiring a car from 16/03/2013- 23/03/2013 - will be £184.92 including insurance cost.

Obviously my outgoings are increasing the longer thing take to resolve.

My total outgoings are so far:

Car Hire cost 11/03/2013 - 23/03/2013- £ 361.54, which is £27.81 a day.

Insurance on a car I can't drive - £974.82 p/y, which is £2.67 a day. (From 04/03/2013)

Taxi cost to and from car hire place @ £4 each way= total of £8.

Total cost as at 16/03/2013 will be approximately £210.74.

Thats assuming that the ROAD TAX will arrive before weekend.

Please confirm that you accept above by the close of business Friday 15/03/2013.

Sorry for the delay in coming back to you.

I will compensate you £20 per day to cover all cost's upto the arrival of the tax disc with you.

Im sure you can appreciate I cant do anymore as it will become un-economical to have sold the car in the first place.

Alternatively we would need to un-wind the whole deal and ill sell it to the other customer we had interested.

I was going to that, but it took me 3 months to find my dream car... It is just hart breaking at the moment...

I'm drivinf fiesta (not a bad car hire car) but his vRs estate supposed to be our dream family car..

Could risk calling their bluff and asking them to organise it being picked up, as you don't want it on the drive if you don't own it.

Or you could end up with no car, and no hire car either since the dealer would then stop paying for that as well.

I would just hang in there, the V5 should be with the dealer or the OP soon.

I will just wait... was serching on internet to find the best car hire deal and 7 days hire will cost me 95 pounds aint bad...

I jus cant beleive I was so naive... but... when dealer tells you car will be delivered on monday fully prepared and taxed what would you say?

Its time to stop trusting people as I ussualy been doing... its the first time something happened like this... Never had that kind of problem before...

Why are they not giving you one of there stock cars? Rather than paying for a hire car

Personally I would have left the car on the fourcourt until the documents had arrived

Once the V5 and tax is all sorted, you could take them to small claims court for your expenses. You could tell them that they can either agree to cover your costs in full or you will see them in court for them.

It's not your problem that they would lose out. They should have made sure everything was good to go before they sold it in the first place.
