Ouch Three!

No where near the scale of the Ouch and Ouch Too threads but my pride and joy has suffered some damage this evening. 

 

New roundabout so everyone is still learning the lanes.

 

I was in the left lane heading straight over the roundabout (A688 East), the lorry was in the next lane to my right (A167 South).

The lights change to green and we both enter the roundabout, the lorry does the same as this Citroen Picasso except I'm on his left...

I'm half passed the lorry with my rear door level with his front bumper and he drifts over into my lane. I swerve left up to the kerb and stop but its not enough...

The damage, only minor but urggh...

He reckoned he was in the right and I was in the wrong, I wasn't going to argue the point in the middle of a roundabout so I'm guessing this will be a knock-for-knock blemish on my insurance :thumbdown:  

Send your insurance company the photos, those lane markings are bloody obvious!

Also you were ahead of him, how could he have not seen you from his high seating position?

Correct, we were both heading for the same exit, but from different lanes!

I was on his passenger side, he said I was in his blind spot.

 

I did pull over to the left as much as I could and had all but stopped. I even got my hand on the horn before impact but to no avail.

 

In hindsight I should have bumped up the kerb to escape.

He is obviously wrong, its painted in feckin great big letters and arrows.

You were in front of him, the location of the damage shows that. He was driving a van with a massive windscreen, how could have not seen you.

The layout of the junction rules in your favour, I wouldn't worry about a 50/50 in that case - unless their insurance company are morons.

And probably damaged your alloys, and possibly your suspension, and with no contact, then no possibility of claiming on his insurance.

 

I would argue this one, for the sake of your excess and no claims bonus. Don't let a claims handler deal with it - they will go knock for knock - You were in the right, so fight for your excess.

Sorry to hear this mate but those lane photos are your friend in this one as he should not have been going straight on unless he was in the same lane as you, so he was clearly trying to get into your lane rather than the other way around.  Keep arguing as advised above.

 

I'm having to do the same for my step daughter was was hit on the motorway by a cement lorry claiming she too was in his passenger blindspot (she was in lane 1 and he was coming across from lane 2 into 1, lane 2 having previously been lane 1 for him until the junction at which my daughter was joining the M4).  My daughter was extremely lucky not to be killed actually as her car then careered across the motorway, hitting another car and then the central reservation (which is a wall), and rolling 4 times.

Holy smoke, that makes my scuff seem a little trivial. I hope she is OK.

 

I'll ring my insurance tomorrow for advice.

Back on thread though, definitely keep onto them on this one.

This is why I run an forward facing camera. Catches hard evidence. Thinking of investing in one for the rear too now.

You were clearly in the right. Make your insurance fight your case.
