The bit of land on the right hand side where theres two white vans parked. There is an untaxed vehicle on there currently, a neighbour has said its been at least 2 years and its tax expired in 2012. Its parked blocking access to gates. Im not sure if this land is classed as a highway? Or if the dvla can act? A family member recently bought a house here.

From that shot it looks like the land beyond the pavement, towards the 2 white vans, is not part of the Highway, so private land. Therefore the vehicle does not need to be taxed or insured.

If you know the reg you could always check on the Askmids website.

There would be a kerb across the pavement, either side of the entry if it were a public highway. It could be SORN. Report it as an abandoned vehicle to the council.

Whose gate is it blocking, and do they need access through it?

If so, the van owner needs to be politely asked to shift his heaps.

Just because it's on private land doesn't mean they don't have to do anything, it should at least be SORN.

You could claim for the logbook. If they don't respond, you could end up being the registered keeper, and do what the hell you want with it!

Its got plant life growing inside it lol.

I checked out its tax & insurance status. A few of the neighbours want it gone but not sure who owns it

Tow it onto the road. Then leave it. Won't be there long I'm sure.

Put a sign on it, saying that they need to contact you by x date or you're going to tow it as it's blocking access or whatever. Legal or not, might get it moved then.

If you know whos vans,

you ask them to let you get the access if you have the right to it.

 

If the vans are not Exported, Broken for parts etc on the DVLA database,

then they should be Declared SORN maybe.

 

But if there are Registration Plates, thats easy to check.

As to towing onto the road, that would be pretty illegal, and might result in action against the muppet that tried that.

(nobody seems to bother much about vehicles parked on the pavements there anyway.

Let the council deal with it.

No one owns the land, its public land. Anyone can walk or drive into there, it has access for pretty large vehicles( skip waggon)

The vans in the picture arent the problem, there the previous owners of two propertys who have left, theres a smaller vauxhall vehicle out of sight, i cant view it on google streetview. I dont think the gates that are been blocked get used to often, they dont really need the gates tbh. If the family member rebuilds the wall on there property and reinstalls the gate, it will be in the way then.

Just because the public can access the land does not mean it is publicly owned. If it is access to properties then it could be owned by all those that have that Right.

Would that not be in the deeds when you buy the house that has access? Or mentioned?

Different countries in the UK and different laws,

but i think pretty common to Scotland, England Wales and Northern Ireland is that Land Open to the Public mean Vehicles on that land are subject to Traffic Law. Even when it is not a Public Highway.

 

The right to access to properties, and crossing others land is also different in different Countries in the UK.

 

The deeds will show if your relatives land can be accessed from the land behind,

that should all have been checked as part of the purchase of the house.

 

If the Land is Owned by the Public/Council or 'For the Common Good', then the Council will have responsibility to ensure lawful use of the land including vehicles on it,

& to make sure people can gain access to their property.

Its not currently blocking access to the property at the rear of my family members house but in the next fort night it will be. One of the neighbours have said its been there over 2 years and no one has ever been seen it or around it. Maybe its nicked

Also the front number plate has been removed, that can be seen from the road. The rear one is still attached

Well when it is give the cops a call if you can't find owner
