If the facts are exactly as you say they are, you might, and I only say might, be able to go to court, plead guilty, but argue special reasons not to have your licence endorsed on the basis of shortness of distance travelled

 

You would have to attend court in person, and give evidence under oath, and be cross-examined by a prosecutor, but it's a possibility

 

It is entirely down to the court sitting on the day whether or not they accept it as such, but if you armed yourself with previous insurance certificates etc to show that you have been insured recently, you never know

 

I wont be going to court.

 

I going to take the points and fine through the "Plead guilty by post" as i deserve it but make sure i fill in the statement part with the distances covered, prev insurance, MOT, TAX, and reasion for moving the vehicle after sitting for 6 months and a very very very

apologetic section.

 

The car touched the public highway for bang on 3minutes according to my "AVG time" on my dash.

Well what is the Offence.

 

Go to court and explain yourself, get the MOT Station Manager as your witness.

But it must be truthful because Perjury is rather serious.

I told the officer i had a pre-booked MOT at a local garage but it never flagged on a system..

A pre-booked MoT might be relevant regarding road tax if you were travelling directly to the MoT, but it wouldn't excuse you from having insurance

I never said anything about an MOT earlier until i was asked.

 

My MOT is on the 4TH SEPT, i booked in good time to fix these problems.

 

I wasnt trying to "excuse" myself... simply stating to the officer and to you all WHY the car was where it was. i would love to see someone completely rebuild a car, book an MOT and it not fail or develop a problem on the way within 24hr.

 

As i am a mechanic i know what i need to check for MOT and the best way to check them, simply finishing the car and then driving it 5miles to an MOT centre would be a hazzard.

I would like reduced which is my on the statement on the from ill recieve am going to put exactly why it was where it was at that time.

 

But i will accept my guilt if they feel like they need to uphold the law happily as i was breaking the law...

Court really isnt an option for me, Im young, i drive a highly modded car, and i was on a small street with no insurance.

 

Boom that'd be a easy win for them, 9 points for me and up to £5000 fine, which i dont have sitting around.

I asked you about the MOT & TAX or SORN because it is relevant and you kept not mentioning it and it is relevant.

 

I seriously suggest you take Brimmas advice, do go to Court and put up your Mitigation and try to impress who ever hears your case.

 

Being a Mechanic & the fact the Offence is Uninsured, it is worth the effort IMO & IME.

I'm also a little surprised as to how happy you seem to take the fine and points for such a minor detail? I'd be fuming if that was me and do my best to get it reduced or cancelled! In regards to your first question, I also wouldn't tell your insurance company until it is confirmed that you have them and they come through the door etc. when I phoned mine up to inform them I'd received 3 points they just say fine thanks for letting us know, it will have no effect until you come to renew your insurance.

& a Banned Motor Mechanic is an Issue, and an Ex Banned or with points 22 year old Mechanic is an Issue.

 

I had so many T Shirts in the long ago past, (when Young) i could hardly get a Boiler Suit on.

Any chance you were nabbed for 3 minutes on the road only once because of the fall out with your last employer.

But then things like that do.  You put too much Detail on a Public Forum about painting the roof.

If you are suggesting someone dobbed you in, how did they know you were just going onto the road at that time, and how did there just happen to be a policeman around at the time? I'm sure they've got better things to do with their time

But if it was only once for 3 minutes out of the drive, & its not a regular thing,

then it would be a pure coincidence & very unlucky. 

But then that usually is just how it does happen.

I agree with Brimma, if it were me, as much as I'd be ****ting bricks about going to court I'd do it for the sake of saving myself from as many points as possible. You've done something wrong and fair play for holding your hands up but 6 points is in the situation you describe a bit harsh IMO.

How did the copper get you in 3mins? Even if the copper happened to be parked around the corner, its going to take more than 3mins to run the checks even if he suspected immediately that the car wasn't insured. And by the way he gave you the tap he knew.

 

If he'd been tipped off then that must have been because you had been putting the car on the road previously and someone reported this behaviour. Even then how long would he have had to wait in order to catch you doing it?

 

If he's a friend of your ex boss then he must be one hell of a mate to sit watching your house for weeks on end on the off chance you move your uninsured car on to the public highway.

 

Something doesn't add up.

Being harsh but:

The Offence is having a car on the highway without insurance. 

It doesn't matter how long time it is there, 1 minute or 30 minutes, the Offence has been committed.

The question most insurers now as is you you have any points/prosecutions or any pending.

You would also need to declare the no insurance to the insurer, it'll be in the terms and some will void your insurance which will lead to another headache ever trying to get insurance.

I would be honest from the start as it'll only become more expensive for you if you don't which will make keeping your car almost impossible without a seriously hefty premium.

Your premium will almost certainly double as it is once the points are factored in, and few insurers will touch you on a modified car
