Hello all

 

Just wondering how long it usually takes for a "Plead Guilty by post" summon to come through the post after i was cautioned on Sunday the 24th Aug.

 

As i am trying to sort out my insurance i obviously dont know how many points im getting. The offence i was cautioned for usually carries 6 points and a £250 fine, at a minimum...

 

Confused to what i say to insurers? I have 6 points or a pending 6points? or a pending offence awaiting points~?

 

Im going to get some insurance sorted asap so it obviously shows im not some con artist trying to sway the system as i am a genuine guy, never had ANY offences through driving at all. Pulled over only a handfull of times.

 

Please help!

After I got three I immediately called my insurer (Chruchill at the time) and they told me I didn't need to inform them until renewal quote time. Other insurers may differ.

The insurers I spoke to today did.

Sounds like the OP was caught driving without insurance given that he's now trying to sort some.

If you've got 6 and are looking at another 6, you won't get the option, you'll just get a summons.

and just then put on a SORN.

Was it Taxed & MOT'd when Uninsured but on the road?.

Wasnt exactly going to go any distance with no bumper or headlights and a pretty severe oil leek now am i.... i moved about 7feet in total.

 

I have no points at all, this would be my first 

 

So. i dont currently have any points but will probably in the next few weeks or months, do i tell the insurers WHEN i recieve them or tell them i will be getting them, or insure it PRIOR to 6 points?

Yes i had insurance under my name and only me about 4months ago BEFORE my build started, i uninsured it then as i wasnt going to be using it at all for a few months.

So was it Taxed & Mot'd.

& is it Modified and you need to insure it as such or just a standard car?

I think what happened is a material fact which should be declared to the insurer.

Yes its modified, i had insured it with all my current mods on thinking id have my build done over a week, so i paid for ALL mods before i actually installed any.

 

But it took longer than i though so i cancelled my policy as it was just wasting money....So i though

Booked in for MOT next thursday from a week ago, TAX would follow on pickup of car obviously with the valid MOT CERT

Extremely unlucky.  I would insure it without declaring the points simply because you do not have any pets on your licence at the time of purchasing your insurance.

 

 Entirely up to you if you choose to inform the insurance company if/when you do get your points.  Bit of a mine field but the Plod could have been a bit more diplomatic, no wonder they are regarded as "two-hats" (say it quickly)

You might have a Penalty coming to you from the DVLA for no VED.  But that really will be bad luck.

The way this year is going i wouldn't be at all surprised..

But you are being done for only the Offence of no Insurance on the Public Highway.

 

So you were on the Public Highway while 'Declared Off Road.'  

So maybe the Officers just reported you as Uninsured, but you were No Road Tax and no MOT.

If the facts are exactly as you say they are, you might, and I only say might, be able to go to court, plead guilty, but argue special reasons not to have your licence endorsed on the basis of shortness of distance travelled

 

You would have to attend court in person, and give evidence under oath, and be cross-examined by a prosecutor, but it's a possibility

 

It is entirely down to the court sitting on the day whether or not they accept it as such, but if you armed yourself with previous insurance certificates etc to show that you have been insured recently, you never know

Well yes i accept that as it was a stupid move to move the car...

 

He cautioned me and gave me the whole "Evidence in court" thing, and siezed the car.

 

I honestly will accept the points and fine as yes it was my fault, but to be done for a 7foot maneuver i think was a little "keen" on his part mabye, but then again it was the fella's job and he's sticking to it so i dont blame anyone but me.

 

I told the officer i had a pre-booked MOT at a local garage but it never flagged on a system.. 

I was done loading a Off Road Bike on a Trailer on the road, pushing across the pavement.

You had a Pre-Booked MOT on the day you were caught on the Road?

Pre Booked written in a Desk Diary, not on a Computer.

 

You should have gone to that Test then on the day, then no offence would be committed.

 

You just dont get a mate to Write a Pre-Booked MOT in the Diary, because that becomes a whole other offence.
