Think I've made a schoolboy error? Traded in my Yeti for a Scout back in July from DM Keith in Huddersfield deal was OK but a bit out of my local area. On pickup day as mine was on a private plate the salesman said he would send the V5 after he received the V5 for mine which I did in a week saying I should have the V5 for the new one in 3 weeks. That was my mistake left the dealer without the new keeper section! After a month I contacted the salesman without response so then contacted Skoda customer services who were very sympathetic and contacted the dealer who said they had sent the V5 to the DVLA and I should have it soon. We are now in September and still no V5 so gave the DVLA a call who told me in no uncertain terms they hadn't received anything from DM Keith and that as the law had changed I shouldn't be driving the car as it wasn't taxed in my name. So then a 40 mile round trip to the garage to see what was going on. Talked to a guy there not the salesman who sold the car to me, who said that they hold onto the logbooks for 90 days and that should of been explained to me at the time of sale which it wasn't or I would not of bought the car! He seemed to think it was no big deal as the car is taxed but not by me. Have contacted customer services again but though they are very sympathetic they are toothless and have little power over the dealers. So where do I stand legally do I just wait to the middle of October for the V5 but what about my car insurance? What if I get pulled up or have an accident and I am not on record as the registered keeper so might end up being prosecuted for no tax. I will learn from this mistake and not leave without the new keeper section in my hand next time. I am sure people will say this is normal practice for pre-reg cars but with the road tax changes has increased the chance of problems for the new owner.

I expect, legally, you have no valid tax or insurance. Whether you would be done for that in a road side check is another matter.

 

I don't care what anyone would claim to be 'normal practise', but I'd never take a new car without the green slip. Its as important as the keys. Likewise, I only give dealers their part and take mine when I trade it in, regardless of how much they protest or say its not necessary. A previous car racked up 5 NIPs within a few weeks of being traded in, but I had sent off the docs to the DVLA so all I got was the 'can you tell us who you sold it to?' letters.

Apparently I'm in breach of section 43c of the Vehicle Excise and Registration Act 1994 by using the car. The advice I have been given is that the dealer has cheated me by selling me a car registered to the dealership as a demonstrator in order to secure a bigger discount from the manufacturer. They are in breach of The Consumer Protection from Unfair Trading Regulations 2008 (CPRs) that creates an offence of 'misleading omissions'. I can leave that car with the dealer and demand my money back in full. Going to see my solicitor today to get advice on my next move. The dealer in question promotes itself as having family values and integrity and treating you as a member of the family but are quite happy for me to drive about in one of their cars illegally.

Have you spoken directly with the Dealer Principal rather than Sales People or the Sales Manager?

 

Pre-Registered is rather different from a car the Dealer registered as a Demonstrator for their Dealership and which they are supposed to keep for 3 months / 3,000 miles and they get at a discount and with Tax benefits and can sell for a greater profit.

 

Skoda UK Customer Services really should have a Senior Customer Services Manager on this and 

'Alasdair Stewart Skoda UK Brand Director' needs to get his team dealing with these common deceptions by Skoda UK Official Dealerships employees.

Thanks for the contact details of David Allen it is much appreciated will try and contact him later today in office hours. I always do things by the book with cars can't believe I have been caught out this time? I am avoiding driving the car now but have to use it to get to work though.

Problem swiftly and amicably resolved today in Huddersfield have returned the car for a refund and even got a lift home. My faith in online forums has been restored think they made a difference to the outcome.
