I was travelling along the motorway after leaving work earlier. In the middle lane was a local works van, blowing out from the back was some dust / sand. I was in the outside lane going to pass him when some kind of object is wind lifted from his van and slams onto my bonnet and wind screen.

It has left a nasty scratch on my bonnet and a small mark on the screen, the screen isn't really major but I'm gutted about the bonnet.

I have a video which I decided to take after the event to show the debris flying from the van but not the actual event itself.

I have contacted the company liable for the damage to my bonnet and they are saying they find it hard to believe as the van was swept out etc. They have also asked me to call in to view my video on Monday morning. Obviously I wouldn't waste my time if it didn't occur.

If they where to say no we ain't liable so we won't offer to repair etc then how would I possibly take it further?

I'm hoping it is sorted on Monday but you know what company's are like from trying to get out of paying out etc.

Call the police and show them the video, if you dont mind being ticked off for driving with your phone.

 

I hit a lump of concrete on the A14 that took out the undertray and inner wing and suspension arm of my old octavia and when i pulled in to check damage a police car pulled up and pointed out a lorry was stopped for a loose load. The lorries insurance repaired my car. Other than damage to my car there was no evidence to show it was caused by the lorry, I never even saw the lorry.

 

The police will gather the info I am sure and I suspect you might be lucky. I would report it and get an incident number. That way you can tell the company you have reported an accident like you are spposed to do?

If you can show the whatever coming out of/off their van, then they're guilty of using/causing or permitting the use of a vehicle with an insecure load.

Spoke with the firm and they playing the wild card but they have spoke about getting my car repaired by a local body shop with who I'm friends with who has let me know.

Snag is I won't be having my motor near there for body work as I know it won't be the best so it's my way or highway really.

Looks like I'll have to go ttrough their insurance direct if they don't agree to my terms tomorrow.

Sound slike you are getting somewhere though.

 

You could have the car repaired there, you never know, but you could tell them if you arent happy with the finish then they will be paying out again. At the end of the day if the paint job is bad they cant deny it.

One issue now is that from my own experience the police are EXTREMELY reluctant to even allow you to report such an incident. It means they have to formally investigate the incident and see no value as it just then becomes a negative statistic regarding road accidents that prefer not to have on the books.

 

I came around a blind bend and hit a massive kerb stone that had been flicked by a bus into the carriageway and had very similar damage to whitep, I had photos of the markings and fragments of the bus left by the stone, there was no arguing the fact it came from the local bus company, but the police officer at the local nick wasn't even prepared to entertain me until I told him it was the law and even then I had to insist I needed t formally report it for insurance purposes despite me telling him that I thought it was the law to report road traffic accidents as such. He was not the slightest bit interested even though people had sustained aggravated injuries as well

Old boss of mine had his Celica nearly written off when a lorry flicked a railway sleeper that was lying at the roadside under his car. I think he had to pay that one out himself. Practically destroyed the front suspension, radiator, lower bodywork and other stuff.

I'd say that the lorry wasn't negligent there, but the person who dumped the sleeper.
