TSR (of Bridgwater)

Oh great piles of pooh!!!!

Since my car suffered an engine failure at at TSR trackday back at the end of November, it was trailered back to TSR for a rebuild and cc increase to 2litres. Problem was pistons were not forthcoming so long delays. Earlier this month I find that the boss Neal Purchase had left and now, after two days of no answer on the phone, I read on Club GTI that they have ceased trading.

They have my car which I guess has no engine and I have pre-paid

Phone the credit card company now!

You have spent their money not your own to make the purchase. The have more bargainaining power than you do.

The credit card company will have provided protection on your purchase. Call them yesterday.

Also you need to find out if they have ceased trading, because if they have you need to make sur eyou get hold of the people taking care of that matter so you can tell them what in that place is yours eg car plus engine.

It is quite common for comapnies to cease trading then restart under a different name.

If the MD left some time ago this can be because he knew they were going to go under so hung up his director's hat before it happened. By doing this he avoids being banned from directorship and can simply start the business again under a different name and a debt free slate with all of the provious companies' suppliers.

From your point of view this is good because it may mean they have all the parts for your car. However they may want to be re-paid for the work.

With a car (and parts of) you are in quite a good position as it is clear to see the car belongs to you and is not an asset of theirs.

Do you know what their exact trading name is? Are they a limited company? If they have ceased to trade, then they should have appointed someone to deal with their affairs, more than likely an insolvency practioner. They normally tend to get all of the mail etc re-directed to their office to deal with and they also attend the premises too in order to ascertain what assets and liabilities that the business may have; you need to let them know asap that they have your car and that you have also paid in advance for work to be undertaken. You may also find that they put their contact details on the premises for people like yourself so then you are able to contact them direct. If it is a limited company, let me know, and I will see if I can find out who, if anyone, had been appointed

The company refers to itself as TSR Performance Ltd on their invoice T&C but does not give a company number. They do have a VAT number though: GB 429 2255049

Their return is overdue too, which gives the impression they are in trouble.

Thanks for advice so far, keep it coming. Have contacted Somerset Trading Standards as a start, will contact credit card company when I get home to find out what I've paid so far and when. :-(

I think that TSR Performance is actually the trading name of TSR PERFORMANCE TEAM LIMITED' date=' and the differing address is that of the registered office of the limited company, so they are one and the same.

I have just been onto Companies House to order the accounts/director details etc, but the site is pretty slow, so I will download it later tonight and let you know my findings

These SIC codes are very 'loose', companies tend to have to find their best match. I might even be totally wrong with this company tbh, but I wont know until I have downloaded the information, so fingers crossed that I am right and if not

As has been said before , your credit card company will reimburse you for goods and services paid for but not yet received so your money should be safe.

As for getting the car back ASAP , once you have established which of the above companies is the correct one I'd recommend sending a recorded delivery letter to their head office and the garage site itself making it clear that the vehicle is your property and not theirs and that you need to reclaim it.

This will help if there are still staff doing some work , or if new owners/receivers take over the business and it's not clear who owns what.

Ah! see, I'm not just a pretty face

I have a friend who is an insolvency practioner, I'll drop him an email and see if he can find out for you the status of the company and who is dealing with the liquidation. Companies House will take an age to update with this sort of information.

It will be interesting to see who's actual address the registered office is at, it may be their accountants or it may be their home address - I will let you know asap
